5.36.010 Purpose.

The city of Newport finds that it is the purpose of the chapter and subsequent amendments to comply with the Cable Act of 1992, enacted by Congress on October 5, 1992. (Ord. 845 § 1, 1994)

5.36.020 Regulations.

The city will follow the FCC Rate Regulations in its regulation of the basic service rates and charges of the company and any other cable television system operating in the city, notwithstanding any different or inconsistent provisions in the franchise.

In connection with such regulation, the city will ensure a reasonable opportunity for consideration of the views of interested parties. (Ord. 845 § 2, 1994)

5.36.030 Power of authorities.

The mayor, or his designee, is authorized to execute on behalf of the city and file with the FCC such certification forms or other instruments as are now or may hereafter be required by the FCC Rate Regulations in order to enable the city to regulate basic service rates and charges. The forms filed and letters sent by the mayor or his designee in respect to cable rate regulations are ratified. (Ord. 845 § 3, 1994)

5.36.040 Violation – Penalty.

Any violation of the regulations adopted by reference herein is a violation of this code punishable under NMC 1.16.010 and 1.16.020 or by way of alternative and additional remedies, those provided for in the franchising ordinance. (Ord. 845 § 4, 1994)
