3.02.010 Biennial budget.

In accordance with the provisions of Chapter 35A.34 RCW, beginning with the biennium starting January 1, 2019, there is hereby established a biennial budget. Beginning with the biennium starting January 1, 2019, and/or all subsequent bienniums there shall be one budget covering a two-year period for the city of Ocean Shores. The 2019-2020 biennial budget and all subsequent budgets shall be prepared, considered, and adopted pursuant to the provisions of this chapter and Chapter 35A.34 RCW. 3.02.020 Mid-biennium modifications.

In accordance with RCW 35A.34.130, a mid-biennium review and modification of the biennial fiscal budget shall occur in 2019, no sooner than eight months after the start of the first year of the fiscal biennium, nor later than the conclusion of the first year of the biennium, and during the same periods in odd-numbered years thereafter. No later than the first regular meeting of the city council in the month of November of the first year of each biennial fiscal budget, the mayor shall prepare proposed budget modifications to be effective as of January 1st of the following year. Such proposal shall be filed with the city clerk and be submitted to the city council and shall be a public record and be available to the public. A public hearing shall be held by the city council to consider the proposal no later than the first regular council meeting in December and may be continued from time to time when necessary. At such hearing or thereafter, the city council may consider a proposed ordinance to adopt modifications, which ordinance shall be subject to Chapter 35A.34 RCW. (Ord. 1015 § 2 (part), 2018)

3.02.030 References to “budget” or “annual budget.”

All references to “budget” or “annual budget” contained in the Ocean Shores Municipal Code or in the ordinances of the city of Ocean Shores shall be interpreted as referring to the “biennial budget.” (Ord. 1015 § 2 (part), 2018)

3.02.040 Severability.

If any section, subsection, sentence, clause, phrase or word of this chapter should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section, subsection, sentence, clause, phrase or word of this chapter.
