10.40.010 Definitions.

A.    “Bicycle” means every device propelled solely by human power upon which a person or persons may ride, having two or more tandem wheels, or any combination thereof, which is either maneuvered by means of handlebars or movement of the feet upon pedals, and which is driven by gears or a chain.

B.    “Business district” means any roadway, shopping mall or sidewalk from Damon Road south to J.K. Lewis Street, and from Dolphin Avenue on the east to two hundred feet east of Ocean Shores Boulevard on the west.

C.    “Non-traffic area” means any roadway within the city limits of Ocean Shores paved or unpaved which are not utilized by motor vehicle traffic.

D.    “City street” means every public highway, road, thoroughfare or part thereof located within the city limits, except alleys.

E.    “Hours of darkness” means the hours from one-half hour after sunset to one-half hour before sunrise, and any other time when person or subjects may not be clearly seen at a distance of five hundred feet.

F.    “Flow of traffic” means the direction in which motor vehicles are traveling upon the roadway, from the centerline to the roadway’s edge.

G.    “Right of the roadway” means the extreme right portion of the roadway which is safe to ride upon.

10.40.020 Certain bicycles prohibited from being ridden in business district.

Bicycles which have wheels measuring less than twenty inches and have the bicyclist’s seat lower than six inches above the wheels, commonly referred to as “fun cycles,” “low riders,” and/or “banana peel bikes” are prohibited from being ridden in the business district. All such bicycles must meet the requirements set fourth in Section 10.40.050 herein. (Ord. 729, 2002)

10.40.030 Exemptions.

Non-traffic areas are exempt from Section 10.40.020, provided the bicyclist has the owner’s permission to ride thereon. (Ord. 729, 2002)

10.40.040 Riding upon city streets.

A.    Bicycles are to be ridden with the flow of traffic when operating upon city streets.

B.    Bicycles are to be propelled on the right hand side of the roadway.

C.    Bicycle riders are to follow the rules of the road while operating upon city streets.

D.    No person riding upon any bicycle, coaster, roller skates, sled or toy vehicle shall attach the same or himself/herself to any vehicle upon a roadway.

E.    A person propelling a bicycle shall not ride other than upon or astride a permanent and regular seat attached thereto.

F.    No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped.

G.    Every bicycle rider shall have at least one hand affixed to the handlebars while in motion.

H.    Bicycles shall not be ridden upon any sidewalk in the city limits.

10.40.050 Equipment.

A.    Every bicycle when in use during the hours of darkness shall be equipped with a lamp on the front of the bicycle which shall emit a white light visible from a distance of at least five hundred feet to the front. Every bicycle shall be equipped with a red reflector on the rear of the bicycle in the manner and of a type approved by the Washington State Patrol. Said reflector shall be visible from all distances up to six hundred feet to the rear.

B.    Every bicycle shall be equipped with a brake, which will enable the operator to make the braked wheels skid on dry, level, clean pavement.

C.    Bicycles which have wheels measuring less than twenty inches and have the bicyclist’s seat lower than six inches above the wheels shall be equipped with a permanently attached, rigid staff, not less than six feet high. Said staff shall have a bright orange reflector flag not less than eighteen inches square permanently attached at the top of the staff.

10.40.060 Rentals.

Every person or entity renting a bicycle to any individual shall advise that individual, in writing, of the size requirements necessary to ride a bicycle within the business district. (Ord. 729, 2002)

10.40.070 Violation—Penalties.

Any violation of this chapter is a Class 3 civil infraction with a maximum penalty of fifty dollars plus statutory assessments. (Ord. 763 § 7, 2003; Ord. 729, 2002)
