2.56.010 Definitions.

Definitions in this chapter shall be the same as those enumerated in RCW 68.04.010 through 68.04.240, inclusive. (Ord. O-300 § 1, 1957).

2.56.020 New cemeteries – Plat approval required.

Every cemetery within the county established after the effective date of the ordinance codified in OCC 2.56.010 through 2.56.090 shall, before filing a plat of the proposed cemetery, submit to the county planning commission a true copy of said plat. This plat shall contain an accurate scale description of the proposed cemetery showing all lots to be sold, placement of shrubberies, flowerbeds, monuments, irrigation systems, roads, and pathways; also it shall include land embracing 10 or more acres. This plat is to be followed in the construction of the cemetery and, if any later major deviations from the plat are to be made, a plat containing said changes shall be submitted to the county planning commission, in advance of the changes, and approved by the commission. (Ord. O-300 § 2, 1957).

2.56.030 Endowment care cemeteries.

A. Any cemetery established after the effective date of the ordinance codified in OCC 2.56.010 through 2.56.090 shall be an endowment care cemetery within the provisions of RCW 68.40.010 through 68.40.090 or as the State Legislature may hereafter amend the statutes relating to endowment care cemeteries.

B. The cemetery shall have 10 or more acres of land developed before sales of lots within the cemetery commence; provided, that if less than 10 acres are developed, the cemetery shall still be an endowment cemetery, and a performance bond approved by the county prosecuting attorney in the amount of $50,000 shall be filed with the county auditor, this bond to be conditioned upon the proper development of the cemetery in accordance with the filed plat; and if, in the opinion of the county commissioners, the cemetery has not been developed according to the plan filed in the county auditor’s office, then said bond shall be forfeited to the county and shall be used to maintain the cemetery. (Ord. O-300 § 3, 1957).

2.56.040 Accessways and rights-of-way.

The cemetery shall have an adequate access road leading to and from the cemetery property on to the public road and shall be so situated that there shall not be created any traffic congestion or hazard. The planning commission shall be satisfied that property so selected shall not impede any potential rights-of-way, public or private. (Ord. O-300 § 4, 1957).

2.56.050 Maintenance and drainage.

Before there is issued a permit for a cemetery, the county planning commission shall be satisfied that there is adequate water, irrigation, or domestic, to maintain the plant life shown upon the submitted plat. The cemetery authority shall also provide for adequate drainage. The drainage conditions and system shall be passed for approval or disapproval by the county health officer or his deputies. (Ord. O-300 § 5, 1957).

2.56.060 Fencing or hedging required.

The cemetery property is to be enclosed by either fencing or hedging or in a similar and suitable manner to prevent animals, wild or domestic, from coming upon the property. (Ord. O-300 § 6, 1957).

2.56.070 County office and agent required.

The cemetery authority shall maintain an office within the county and have an agent of the cemetery authority within the county. (Ord. O-300 § 7, 1957).

2.56.080 Permit issuance when.

When the county planning commission is satisfied that the requirements in OCC 2.56.010 through 2.56.070 have been met or provided for, they may issue a permit. (Ord. O-300 § 7, 1957).

2.56.090 Nonapplicability of provisions.

The ordinance codified in OCC 2.56.010 through 2.56.090 shall not apply to any bona fide religious corporation, church, religious society or denomination or any cemetery organized, controlled, and operated by any of them, or any county, town or city cemetery. (Ord. O-300 § 7, 1957).

2.56.100 Cemetery District No. 1.

The territory comprising Winthrop City, Winthrop Rural and Mazama Precincts:

Beginning at a point which is the southwest corner of Section 31, Township 35 North, Range East, Willamette Meridian; thence go south three miles to the southwest corner of Section 18, Township 34 North, Range 21 East, Willamette Meridian; thence go 10 miles east to the southeast corner of Section 15, Township 34 North, Range 22 East, Willamette Meridian; thence go north two miles to the northeast corner of Section 10, Township 34 North, Range 22 East, Willamette Meridian; thence go east two miles to the southeast corner of Section 1, Township 34 North, Range 22 East, Willamette Meridian; thence go south two miles to the southwest corner of Section 18, Township 34 North, Range 23 East, Willamette Meridian; thence go east seven miles to the southeast corner of Section 18, Township 34 North, Range 24 East, Willamette Meridian; which point is on the boundary line between Hospital District No. 1 and Hospital District No. 3. Thence go north along the east boundary of Hospital District No. 1, which line is also the west boundary of Hospital District No. 3 and Hospital District No. 4 to the Canadian border. Thence go west along the Canadian border 41 miles to the west boundary line of Okanogan County. Thence south along the West boundary line of Okanogan County to the south line Township 35 North, Willamette Meridian; thence go approximately 17-1/2miles east to the point of beginning, which is the southwest corner of Section 31, Township 35 North, Range 21 East, Willamette Meridian,

is declared to be a duly organized cemetery district, to be known as Okanogan County Cemetery District No. 1. (Res. 40-76 § 1, 1976; Res. K-681, 1948; Res. K-657, 1948).

2.56.110 Cemetery District No. 2.

The territory embraced within the boundaries described as follows:

is declared to be duly organized as a cemetery district under the laws of the state as provided by law, under the name, style, and designation of Okanogan County Cemetery District No. 2. (Ord. M-288, 1953).

2.56.120 Cemetery District No. 3.

The following described territory is declared to be duly organized as a cemetery district under the laws of the state, said cemetery district to be known and designated as Okanogan County Cemetery District No. 3:

A. Township 30 North, Range 23 E.W.M.:

The S 1/2-SW 1/4 of Section 1, All of Section 2 except NE 1/4, All of Sections 3, 10, 11, 12, 13, 14, 15, 22, 23, 24, 25, 26, 27, 28, 29, 31, 32, 33, 34, 35 and 36, except that portion of Section 36 lying East of the Columbia River; east half Sections 4, 9, 16, E 1/2 and SW 1/4 Section 21;

B. Township 30 North, Range 24 E.W.M.:

Sections 19 and 20 and that part of Sections 29 and 30 lying north of the Columbia River;

C. Township 30 North, Range 22 E.W.M.:

Sections 32, 33, 34, 35, and 36, and that part of Section 31 lying in Okanogan County;

D. Township 29 North, Range 23 E.W.M.:

All of Section 1 lying west of the Columbia River; All of Sections 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 22, 23, 24, 25, 26, 27, 35, and 36;

E. Township 29 North, Range 24 E.W.M.:

All that part of Sections 7, 18, 19, 30, and 31 lying west of the Columbia River.

2.56.130 Cemetery District No. 4.

The Cemetery District No. 4 of Oroville is established as prescribed by law by virtue of the formal elections and hearing held in Okanogan County November 4, 1980, and February 3, 1981, by order of the Okanogan County commissioners.

OROVILLE #1: All of those portions of the incorporated limits of the Town of Oroville lying south of the Burlington Northern Railroad tracks.

OROVILLE #2: All of those portions of the incorporated limits of the Town of Oroville lying north of the Burlington Northern Railroad tracks, west of Main Street (U.S. Highway 97, Route 10) including that area bounded on the north by the city limits, bounded on the west by the centerline of Main Street and bounded on the east by a line running due south from the northeast corner of the incorporated limits to its intersection with the centerline of Main Street.

OROVILLE #3: All of those portions of the incorporated limits of the Town of Oroville lying north of the Burlington Northern Railroad tracks and east of Main Street.

BEGINNING at the NW corner of S. 1, T. 40 N., R. 26 E.W.M.; thence east to a point midway between the banks of Osoyoos Lake; thence southerly along a line following the middle of Lake Osoyoos to the source of the Okanogan River; thence southerly along the Okanogan River to the Burlington Northern Railroad tracks; thence northwesterly along the tracks to the railroad bridge crossing the Similkameen River located in S. 20, T. 40 N., R. 27 E.W.M.; thence northwesterly up the Similkameen River to the south boundary line of S. 18, T. 40 N., R. 27 E.W.M.; thence west to the SW corner of S. 13, T. 40 N., R. 26 E.W.M.; thence north to the POINT OF BEGINNING. EXCEPT: Those portions located within the incorporated limits of Oroville.

BEGINNING at the NW corner of S. 3, T. 40 N., R. 23 E.W.M.; thence east along the Canadian Border to the NE corner of S. 2, T. 40 N., R. 26 E.W.M.; thence south to the SE corner of S. 11, T. 40 N., R. 26 E.W.M.; thence west to the NE corner of S. 18, T. 40 N., R. 26 E.W.M.; thence south to the SE corner of S. 31, T. 40 N., R. 26 E.W.M.; thence west to the SW corner of S. 31, T. 40 N., R. 26 E.W.M.; thence south to the SE corner S. 36, T. 40 N., R. 25 E.W.M.; thence west to the boundary between the 4th and 5th Legislative districts located on the south section line of S. 33, T. 40 N., R. 23 E.W.M.; thence northerly along said boundary to the POINT OF BEGINNING.
