9.04.010 Curfew regulations generally.

A. Every person, being under the age of 18 years and not being accompanied by a parent, guardian, or a person over the age of 18 years and having legal charge of such person, who shall remain on the streets, alleys, or in any public place or building of amusement or entertainment or upon any public place or building of amusement or entertainment or upon any public highways, unoccupied premises or grounds in the county after the hour of 10:30 p.m. shall be deemed guilty of a violation of this chapter.

B. If the parent, guardian, or other person having legal charge of any person under the age of 18 years, who knowingly permits such person to be upon the streets, alleys, or in any public building or place of amusement or entertainment or upon any public highways, unoccupied premises or grounds in the county, after the hour of 10:30 p.m., unless said minor person has been sent upon some proper or necessary errand by said parent, guardian, or other person having legal charge of such minor, he shall be deemed guilty of a violation of this chapter. 9.04.020 Enforcement authority.

It shall be the duty of the sheriff or any deputy sheriff of the county who finds any minor person under the age of 18 years upon the streets, alleys, or in any public building or place of amusement or entertainment or upon any public highways, unoccupied premises or grounds in the county in violation of this section, to order such persons to immediately return to their homes and, upon failure to comply with the order, such person shall be arrested and detained by the officers. 9.04.030 Violations of OCC 9.04.010 – Penalties.

Any person violating OCC 9.04.010(B) shall be subject to arrest and, upon conviction thereof, shall be subject to a fine of not less than $1.00 nor more than $25.00 or by imprisonment in the county jail for not more than 10 days, or by both such fine and imprisonment; provided, that the arresting officer shall have the right to take under arrest and deliver any minor or minors found violating the provisions of OCC 9.04.010(A) to the parent, guardian or other legal custodian of such minor or minors; provided, that such parent, guardian, or other legal custodian will make sure to such officers that at such time as required, they will have such minor or minors forthcoming to answer the charge conferred against such minor or minors under this chapter. 9.04.040 Curfew regulations inside unincorporated towns or cities operated by the federal government.

It is unlawful for any person under the age of 18 years to congregate, loiter, or be on the streets, highways, public places, or unoccupied premises or grounds in the county, inside the limits of any unincorporated city or town operated by the federal government containing a population of 1,000 or more, after the hours of 10:30 p.m. on Sunday, Monday, Tuesday, Wednesday, and Thursday nights and after the hour of 12:00 midnight on Friday and Saturday nights, unless such person is accompanied by his parent or legal guardian or is sent by his parent or guardian on some urgent business or errand which renders it necessary for him to be abroad after the hours set forth in this section, in which case such person shall personally have with him the written consent of his parent or guardian for that particular business trip or errand. Nothing in this section shall be interpreted as prohibiting minors from traveling over or along public streets by direct route on, to, and from work in the regular course of lawful employment with compensation by responsible third parties when such minors have written evidence of such employment in their possession. 9.04.050 Parental violations of OCC 9.04.040.

It is unlawful for any parent or legal guardian wilfully or negligently to permit a minor under the age of 18 years who is subject to his custody to violate any of the provisions hereof, nor shall any such parent or guardian aforesaid issue a written consent as provided in OCC 9.04.040 except in cases of urgent necessity. 9.04.060 Accompaniment by other than guardian unlawful when.

It is unlawful for any person not the parent or legal guardian to accompany, congregate, or loiter with any minor on any public street, highway, in public places, or upon unoccupied premises or grounds in the county inside the limits of any unincorporated city or town operated by the federal government containing a population of 1,000 or more, except by and with the express consent of the parent or guardian. (Res. L-87 § 4, 1949).

9.04.070 Violations of OCC 9.04.040 through 9.04.060 – Penalties.

A. Any person violating OCC 9.04.040 through 9.04.060 shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not to exceed $100.00, or by imprisonment in the county jail for not to exceed 30 days or both such fine and imprisonment.

B. Any person under the age of 18 years shall be dealt with according to the appropriate juvenile laws of the state of Washington. (Res. L-87 § 5, 1949).
