2.20.010 Statutory authority.

The municipal court of Pomeroy will operate under RCW Chapter 3.50 as amended by Chapter 258, Laws of 1984, state of Washington. (Ord. 637 §1, 1986).

2.20.020 Municipal court judge – Appointment – Qualifications – Duties.

The mayor shall, in writing, appoint a municipal judge of the municipal court for a term of four years. The term of the judge shall commence on January 1 of each fourth year after January 1, 1986, pursuant to appointment as provided in this section. Appointments shall be made on or before December 1 of the year next preceding the year in which the terms commence.

The city council shall have the power to confirm the appointment of a municipal judge.

A person appointed as a full-time or part-time municipal judge shall be a citizen of the United States of America and of the state of Washington; a resident of Garfield County; and an attorney admitted to practice law before the courts of record of the state of Washington, or, a nonlawyer who has passed the qualifying examination for lay judges for courts of limited jurisdiction under RCW 3.34.060 and the Washington Court Rules.

The mayor shall, in writing, appoint judges pro tem who shall act in the absence or disability of the regular judge of a municipal court or subsequent to the filing of an affidavit of prejudice. The judges pro tem shall be qualified to hold the position of judge of the municipal court as provided in RCW Chapter 3.50. The term of the appointment shall be specified in writing but in any event shall not extend beyond the term of the appointing mayor.

The duties of the municipal judge shall be to administer the operation of the municipal court, providing all judicial services as required by statute and court rule, and providing for all clerical services as required by statute, court rule, Office of the Administrator of the Courts, and Office of State Auditor.
