10.60.010 Definitions.

"Compression Brakes" means a mechanical device that utilizes the compression of the vehicle’s engine to retard the forward motion of a Heavy Vehicle. This definition includes, but is not limited to the terms "exhaust brakes" or "Jake Brakes".

"Vehicle, heavy," as used in this chapter means any vehicle, motor vehicle, truck, truck-tractor, trailer or semitrailer or a combination thereof, having a gross weight in excess of twelve thousand pounds.

"Vehicle, long," as used in this chapter means any vehicle, motor vehicle, truck, truck-tractor, trailer or semi-truck or combination thereof, having a total length in excess of twenty-five feet. (Ord 04-142, §1; Ord 485 §1, 1976)

10.60.020 Heavy vehicle – Prohibited use – Designated.

From and after the effective date of the ordinance codified in this chapter, it is unlawful to operate, drive, move, tow, park, or in any way propel any heavy vehicle over, along, upon, or across any street in the City; except those streets designated in Section 10.60.040. No heavy vehicle resting on dollies shall be parked on any street without pads at least twelve inches by twelve inches being placed under the dollies. (Ord 488 §2, 1976: Ord 485 §2, 1976)

10.60.030 Heavy vehicle – Prohibited use – Exceptions.

The limitations set forth in Section 10.60.020 shall not apply to any vehicle while in the actual process of making deliveries to points within the City not located upon such heavy vehicle route streets designated in Section 10.60.040. (Ord 06-171 §1, 2006; Ord 485 §3, 1976)

10.60.035 Compression brakes.

A. No person shall operate a Compression Brake device on any Heavy Vehicle within the City limits.

B. It shall be an affirmative defense of prosecution under this section that the Compression Brakes were applied in an emergency and were necessary for the protection of persons and/or property.

C. This section shall not apply to emergency vehicles. (Ord 04-142, §2)

10.60.040 Heavy vehicle – Routes.

The following streets are designated as heavy vehicle routes within the City:

1. Central Avenue from south City limit to north City limit;

2. "F" Street Southeast from the east City limit to Central Avenue;

3. "F" Street Southwest from the west City limit to Central Avenue;

4. Columbia Way;

5. B Street Southwest from Thirteenth Avenue Southwest to Seventh Avenue Southwest;

6. Thirteenth Avenue North of Highway 28;

7. Seventh Avenue Southwest from "F" Street Southwest North of Division Street;

8. First Avenue Southwest from "H" Street Southwest to "F" Street Southwest;

9. Eighth Avenue Southeast from "F" Street Southeast to "A" Street Southeast;

10. Third Avenue Southeast from "F" Street Southeast north to "A" Street Northeast;

11. Division Street;

12. "H" Street Southwest from Central to First Avenue Southwest;

13. "A" Street Northeast for its entire length;

14. "A" Street Southeast from Columbia Way to Seventh Avenue Southeast;

15. Seventh Avenue Southeast from "A" Street Southeast to Division Street;

10.60.050 Long vehicle – Prohibited use – Designated.

From and after the effective date of the ordinance codified in this section, it shall be unlawful to park a long vehicle on any street in the City except on those streets designated in Section 10.60.040. (Ord 485 §5, 1976)

10.60.070 Route posting.

The streets designated as a heavy vehicle and long vehicle route shall be marked with signs in an appropriate manner. (Ord 485 §7, 1976)

10.60.080 Violation – Civil penalty.

Any person violating any provision of this chapter shall be deemed to have committed a civil infraction and shall be punished as provided in Section 1.01.118(C)(6). (Ord 613 §2, 1982: Ord 485 §8, 1976)
