16.30.010 Cumulative civil penalties – Incurred when.

Any person, firm or corporation violating the provisions of Title 16 shall be deemed to have committed a civil infraction and shall incur a cumulative C-7 penalty for each day, or portion of a day, from the date set for correction thereof, pursuant to this chapter, until the violation is corrected. 16.30.020 Notice of violation – Authority to issue.

Whenever the fire chief determines that a continuing violation of this title is occurring, the fire chief or his designated agent is authorized to issue a notice of violation directed to the person(s) permitting, committing or causing such violation. (Ord 93-27 §2)

16.30.030 Notice of violation – Contents.

The notice of violation shall contain:

1. The name and address of the person(s) to whom the notice of violation is directed;

2. The street address when available or a legal description sufficient for identification of the building, structure, premises or land upon or within which the violation is occurring;

3. A concise description of the nature of the violation;

4. A statement of the action required to be taken as determined by the fire chief and a date for correction which shall be not less than ten days from the date of service of the notice of violation, unless the fire chief has determined the violation to constitute, or reasonably appears to constitute, an imminent danger to the health or safety of the public requiring immediate correction;

5. A statement that a cumulative civil C-7 penalty shall be assessed against the person to whom the notice is directed for each and every day following the date set for correction on which the violation continues; and

6. A statement that if the person fails to correct the violation within the specified time period, a notice of infraction will be issued, or the City may seek any remedy provided by law. (Ord 93-27 §2)

16.30.040 Notice of violation – Service.

The notice of violation shall be served upon person(s) to whom it is directed either personally in the manner provided for personal service of notices of complaint in justice court or by mailing a copy of the notice of violation by certified mail, postage prepaid, return receipt requested, to such person at his last known address. Proof of personal service shall be made at the time of service by a written declaration under penalty of perjury executed by the person effecting service, declaring time, date and the manner by which service was made. 16.30.050 Date for correction may be extended.

For good cause shown the fire chief may extend the date for correction in the notice of violation. (Ord 93-27 §2)
