2.19.010 Definitions.

The following words and phrases used in this chapter shall have the following meanings:

A.    “Commission” means the town of Rainier arts commission.

B.    “Arts” disciplines are defined to include, but are not limited to, music, dance, drama/theater, visual arts, literary arts, media arts, performing arts, interdisciplinary arts, and traditional arts within the city that the city council or the arts commission with the council’s approval, chooses to promote, enhance or develop. 2.19.020 Creation—Eligibility for membership.

A.    There is hereby created an arts commission, consisting of five voting members, each appointed by a majority vote of the city council, four of whom must be from among the residents of the town. Appointments shall emphasize citizens involved in nonprofit arts organizations.

B.    The commission may also appoint auxiliary (nonvoting) members. The commission may from time to time create short-term ad hoc advisory committees that include members who are deemed important in performing the commission’s duties in an advisory capacity. Tenure shall vary with the need as determined by the commission’s voting members. Nonmembers and alternate members shall not have voting rights. (Ord. 472 § 1 (part), 2002)

2.19.030 Compensation.

No commission member shall receive any compensation for his or her services (Ord. 472 § 1 (part), 2002)

2.19.040 Terms of commission members—Vacancies.

A.    Except as provided in subsection B of this section, commission members shall be appointed to four-year terms. Absences of members may be excused by majority vote of the city council. Vacancies shall be filled by council appointment for the remainder of the four year term in which the vacancy occurs.

B.    During the initial organization of the commission, one of the members shall be appointed to a three-year term and two of the members shall be appointed to two-year terms to stagger initial membership expiration.

C.    There shall be a term limit of four consecutive years in addition to the initial short term provided for in subsection B of this section. (Ord. 472 § 1 (part), 2002)

2.19.050 Officers—Meetings—Quorum—Record.

A.    Members of the commission shall meet and organize by electing from the members of the commission a chair, vice-chair, recording secretary, and such other officers as may be necessary. The chair and vice-chair shall be elected for a one year term. All commission members present are eligible to vote. In the event the chair is unable to complete his or her term, the vice-chair will assume the position of the chair until the expiration of the one-year term, and a new vice-chair shall be elected at that time.

B.    The chair shall preside at all meetings of the commission, and in his or her absence the vice-chair shall preside. The recording secretary shall promptly record, keep and publish a summary of the minutes and provide copies of those minutes to the city clerk and the city council. The minutes shall be open to public inspection.

C.    A majority of the commission shall constitute a quorum, and three affirmative votes shall be necessary to carry any proposition.

D.    A meeting of the commission shall be held at least once a month unless canceled for lack of business. (Ord. 472 § 1 (part), 2002)

2.19.060 Powers and duties.

The commission shall:

A.    Develop bylaws to govern the internal affairs of the arts commission. All bylaws must be approved by the Rainier city council.

B.    Serve as the primary voice for the arts within the city and as the principal advisory commission to the mayor and the city council, fostering a high level of quality, creativity, and diversity in the arts and advocating inclusion of aesthetic considerations in local decisions making that may have cultural implications.

C.    Develop cooperation and coordination with schools and local, regional and national art organizations to initiate, sponsor and conduct programs calculated to further public awareness of and interest in fine and performing arts in the town of Rainier. The commission may develop these programs alone or in cooperation with any other private or civic body, or public body of the city, county, state or federal government.

D.    Explore ways to obtain private, local, state and federal funds to promote art projects in the city.

E.    Advise the city council and staff regarding the acquisition of works of art to be placed on municipal property, by purchase, donation or grant.

F.    Advise and assist the city council and staff in connection with such other artistic activities as may be referred to it by the city council or by ordinance.

G.    Accompany all advise and recommendations presented to the council with project funding source options and/or financial reports detailing the projected expenditure for the project.

H.    Encourage grants and donations to the Rainier arts commission account, and make recommendations to the city council regarding expenditures from the account.

1.    Maintain complete records of all transactions and give the city council through any authorized representative, access to and the right to examine all records, books, papers or documents regarding all operations funded by the Rainier arts commission account.

J.    Submit a quarterly financial statement to the city council detailing the use of funds expended from the Rainier arts commission account.

K.    Submit to the city council annually in June of each year, in a form acceptable to the city council, a written report on the status of the activities, programs and projects funded through the use of the Rainier arts commission account. The report shall include a statement of accomplishments for the previous year and work plan recommendations for the promotion and development of artistic activities for the upcoming year. 2.19.070 Establishment of account.

All public and private funds authorized, appropriated, or received by the city for the arts shall be maintained in a separate account within the town’s financial system designated as the Rainier arts commission account. The city council shall approve all expenditures from the Rainier arts commission account upon the advice and recommendation of the arts commission. (Ord. 472 § 1 (part), 2002)

2.19.080 Source of funds.

A.    An amount not less than one thousand dollars ($1,000) shall be place in the Rainier arts commission account in the fiscal year 2003. Thereafter, the Rainier arts commission shall receive regular funding from each year’s annual budgeted appropriations.

B.    The arts commission is authorized to solicit and receive on behalf of the city public and private funds to promote local activities, programs and projects in the arts. Funds from the Rainier arts commission account may be utilized as the city’s local share to acquire matching or grant funds for the arts. (Ord. 472 § 1 (part), 2002)

2.19.090 Balance between arts, education and entertainment.

The arts commission shall allocate funds received from the Rainier arts commission account to activities, programs and projects in a manner that ensures a reasonable balance between the arts, education and entertainment (Ord. 472 § 1 (part), 2002)

2.19.100 Authority to publish.

The city shall have the unrestricted authority to publish, disclose, distribute and otherwise use, in whole or in part, any reports, data, materials or other information prepared with or in conjunction with funds from the Rainier arts commission account. (Ord. 472 § 1 (part), 2002)
