9.24.010 Discharge of firearms prohibited.

It is unlawful for any person to wilfully discharge a firearm, air gun or air rifle, pellet gun or pellet rifle, or similar weapon, or to throw or project any deadly missile in or into a public place, or in or into any place where any person might be endangered thereby, whether or not an injury actually results. 9.24.020 Drawing, carrying, displaying weapon.

A.    It is unlawful for anyone to carry, exhibit, display, or draw any firearm, dagger, sword, knife or other weapon apparently capable of producing bodily harm, in a manner, under circumstances, and at a time and place that either manifests an intent to intimidate or injure another or that warrants alarm for the safety of other persons.

B.    Subsection A of this section shall not apply to or affect the following:

1.    Any act committed by a person with reasonable necessary force to defend his/her place of abode or place of business;

2.    Any person acting with reasonable force for the purpose of protecting him/herself against the use of presently threatened unlawful force by another or for the purpose of protecting another against the use of such unlawful force by a third person;

3.    Any person making or assisting in making a lawful arrest for the commission of a felony; or

4.    Any person engaged in military activities sponsored by the federal or state governments. (Amended during 1996 codification; Ord. 344 § 2, 1994)
