12.12.100    Violation

12.12.010 Purpose.

This chapter establishes regulations governing the use of town parks and defining certain acts to be prohibited. (Ord. 305 § 1, 1991)

12.12.020 Definitions.

As used in this chapter, the following words and phrases shall have the designated meanings unless a different meaning is expressly provided or the context otherwise clearly indicates:

“Alcoholic beverages” means any substance defined in RCW 66.04.010.

“Fireworks” means any item defined in Uniform Fire Code, 1991 Edition, Section 9.108(F).

“Motor vehicle” means any vehicle defined in RCW 46.04.320, as well as any vehicle defined in Section 10.24.020 of this code.

“Parks” means any body of land owned or controlled by the town, and designated by the town council to be a park. (Amended during 1996 codification; Ord. 305 § 2, 1991)

12.12.030 Prohibited acts.

It is unlawful for any person by act or omission to commit or cause to be committed any of the following:

A.    To operate, drive, park or push any motor vehicle in any park except on roadways and other areas specifically designated for that purpose;

B.    To ride or walk any horse, mule, donkey, burro or other such animal in any park except where designated;

C.    To allow any animal to roam unleashed or outside of areas designated for pets;

D.    To possess or consume any alcoholic beverages without a special permit, issued by the town, to do so;

E.    To possess or use any fireworks anywhere on park grounds;

F.    To dump or place any household garbage or litter in park dumpsters;

G.    To damage or cause to be damaged or defaced any tree, shrub, bush or plant in any park. (Ord. 305 § 3, 1991)

12.12.040 Enforcement.

The provisions of this chapter shall be enforced by the Rainier police department. (Ord. 305 § 5, 1991)

12.12.050 Violation—Penalty.

Any person who violates any portion or section of this chapter shall be deemed to have committed an infraction and shall be fined no more than twenty-five dollars ($25.00). (Ord. 305 § 4, 1991)

12.12.060 Closing hours.

All town parks shall close at 10:00 p.m. and reopen at 6:00 a.m. daily, Daylight Saving Time or Pacific Standard Time, whichever is in effect on that day. (Ord. 395 § 1, 1998)

12.12.070 Permit required.

It is unlawful to enter or be in a town park after closing time, without the physical possession of a written permit issued by the director of public works or other official designated by the public works director. This sections does not apply to events and activities scheduled or approved by the Rainier public works department or the mayor, pursuant to approval by the town council. No permit or approval shall be issued under this section except upon written application at least twenty-four (24) hours in advance on a form approved by the public works director and signed by a responsible individual. A copy of the permit shall be delivered in advance to the Rainier police department. (Ord. 395 § 2, 1998)

12.12.080 Sign posting requirements.

The director of public works shall post and maintain 18 x 24 inch signs immediately to the right of each park entrance, plainly stating the park opening and closing hours, and warning that the entry or presence of any unauthorized person in the park during closed periods is a violation of this chapter. 12.12.090 Sign destruction.

Any person who violates any provision of Section 12.12.070, whether directly committing the act or omission or aiding or abetting the act or omission, or who negligently or intentionally destroys or damages any sign posted under this chapter, commits a civil infraction as provided in RMC 12.12.050. 12.12.100 Violation.

Any intentional violation of any provision of this chapter, or intentional damaging or destruction of any sign posted under this chapter, may be prosecuted as a misdemeanor. (Ord. 395 § 5, 1998)
