EMPLOYMENT ELIGIBILITY VERIFICATION

1.0 PURPOSE:

To establish requirements and procedures for verification of eligibility for employment by the city of Renton.

2.0 ORGANIZATIONS AFFECTED:

All departments/divisions.

Title 8, United States Code, Section 1324A. Immigration Reform and Control Act of 1986.

4.0 POLICY:

5.0 DEFINITIONS:

5.1    Employee: For the purpose of this policy/procedure, an employee shall be defined as any non-elected person appointed or selected to perform services for the city of Renton for compensation. This definition includes: regular, part-time temporary, or on-call employees. This definition excludes those persons representing firms or agencies which have been engaged by the city of Renton under contract and who are considered employees of that firm or agency.

6.0 PROCEDURE:

6.1    Employee Responsibilities:

6.1.1    All persons upon being hired by the city of Renton after November 6, 1986, must complete Section 1 of Employment Eligibility and Verification Form I-9 provided by the United States Department of Labor.

6.1.2    To be eligible for employment, the individual must demonstrate U.S. citizenship, lawful alien status for permanent residence or authorization for employment.

6.2    Employer Responsibilities:

6.2.1    The Personnel Department shall be responsible for completing Section 2 of the referenced form for all regular and on-call employees. The hiring department shall be responsible for completing Section 2 of the form for all temporary part-time and seasonal employees.

6.2.2    The Personnel Director or appropriate representative shall certify examination of the documents presented. If certification cannot be made, the candidate will be notified in writing. It shall then become the responsibility of the candidate to provide, if possible, acceptable documentation of eligibility for employment.

6.3    No employment agreement, either verbal or written, shall be made between the city of Renton and any individual described in Section 5.1 of this policy procedure without certification of eligibility.

6.4    Completed Employment Eligibility Verification forms shall be kept on file by the Personnel Department during the tenure of an individual's employment or three years after date of hire, whichever is longer; or one year after termination.
