17.68.010 Applicability.

The regulations, restrictions, and boundaries set forth in this title may from time to time be amended, supplemented, modified, or repealed in accordance with the following procedures; provided, that no change shall be approved that is inconsistent with the Rock Island comprehensive plan. (Ord. 07-093 § 1).

17.68.020 Procedures.

A. Amendments, supplementations, modifications, or repeals of or to this title may be initiated by the following:

1. The Rock Island city council.

2. Property owners by:

a. Filing with the city clerk a petition signed by one or more property owners within the city setting forth the proposed change and the reasons therefor;

b. Payment of the fee to help defray the cost of processing the petition; and

c. The petition must be filed at least 30 days prior to the date of the public hearing where the petition will be considered.

B. Proposed amendments, supplementations, modifications, or repeals of or to this title shall be heard at a public hearing by the city council within 90 days of the time that the petition was filed. No request for a zone boundary or zone classification amendment to this title shall be reconsidered within the 12-month period immediately following a previous denial of such request, except where, in the opinion of the city council, such a hearing is warranted by new evidence or a substantial change of circumstances.

C. Proposed amendments to this title shall be as provided for and applicable to legislative review, pursuant to RIMC Title 14, Development Permit Procedures and Administration. (Ord. 07-093 § 1).

17.68.030 Review of decision.

Any decision approving or disapproving any amendment, modification or repeal of or to this title shall be reviewed in the superior court of Douglas County on the basis of unlawful, arbitrary, or capricious action or nonaction by writ of review or mandates; provided, that the application for such writ shall be made to the court within 21 days from the date of the decision sought to be reviewed.
