Article I. Running at Large

6.15.010 Running at large prohibited.

No horses, sheep, mules, goats or cattle shall be permitted to run at large within the limits of the city of Roslyn. [Ord. 239 § 1, 1917.]

6.15.020 Impoundment.

It shall be the duty of any and all of the police officers and of the pound master of the city of Roslyn to take up and impound any horses, sheep, mules, goats or cattle found running at large within the limits of said city, and all of said work shall be under the direction and control of the chief of police of said city who shall have authority to appoint, and remove, a pound master, whose duties shall be to assist the police officers in carrying into effect the provisions of this article. 6.15.030 Notice.

Whenever any animal shall have been taken up and impounded under this article, the chief of police shall forthwith cause to be posted in front of the City Hall of said city a notice describing the animal taken up and impounded, and giving notice that said animal shall be sold at public auction unless redeemed by the owners at or prior to the time of said sale, and said sale shall take place five days after the posting of such notice. 6.15.040 Sale.

Unless the animal so impounded shall have been redeemed at or before the time set for sale, the chief of police shall proceed to sell the same at public auction in the manner prescribed by law for the sale of personal property under execution and shall deduct from the proceeds of such sale the charges or fees as hereinafter specified, and the balance shall be turned into the city treasury to be held in trust for the owner of said animal. 6.15.050 Charge for impoundment.

The chief of police shall charge and collect $1.00 per head for all sheep, goats and cattle impounded in the city of Roslyn. [Ord. 319 § 1, 1931; Ord. 239 § 5, 1917.]

6.15.060 Payment for performance of work.

Fifty percent of the monies collected under the provisions of RMC 6.15.050 shall be turned over to the chief of police of said city, to be by him allowed and paid to the person or persons, respectively, performing work hereunder, the said payments to be in full compensation for said work. 6.15.070 Redemption.

The owner of any animal impounded under this article may redeem the same at any time before sale by proving property and paying all charges or fees accruing upon the same up to such time. [Ord. 239 § 7, 1917.]

6.15.080 Rescuing – Violation, penalty.

Any person who shall rescue or attempt to rescue any animal mentioned in this article from the pound master or any of the police officers of said city, or who shall in any manner interfere with any of said officials in the discharge of their duties hereunder, shall be deemed guilty of a misdemeanor. 6.15.090 Driving through streets – Violation, penalty.

Any person who shall drive any horses or mules through the streets of said city, unless such animal or animals be under the secure control of such person by the use of halter or reins, shall be deemed guilty of a misdemeanor. [Ord. 1082 § 2, 2011; Ord. 239 § 9, 1917.]

Article II. Keeping of Livestock

6.15.100 Permit to keep livestock in city.

From and after the effective date of the ordinance codified in this article, no livestock shall be kept within the corporate limits of the city of Roslyn except under a permit as hereinafter provided. No permits shall be issued for goats or swine, and it shall be unlawful to keep goats or swine in the city. [Ord. 484 § 1, 1970; Ord. 215 § 3, 1914.]

6.15.110 Livestock defined.

For the purposes of this article, “livestock” shall include all horses, mules, cattle, sheep, goats, mink, poultry, rabbits and all other animals excepting domesticated dogs and cats, and small household birds such as canaries. [Ord. 1082 § 3, 2011; Ord. 484 § 2, 1970.]

6.15.120 Swine prohibited with exception.

No swine shall be kept within the corporate limits of the city of Roslyn; provided, that pot-bellied pigs as defined in Chapter 6.17 RMC shall be allowed in accordance with the regulations set out in that chapter. [Ord. 1082 § 4, 2011; Ord. 484 § 3, 1970; Ord. 215 § 3, 1914.]

6.15.130 Issuance of permits.

All applications for permits to keep livestock within the city of Roslyn shall be made in writing and filed with the city clerk. The city clerk, or such other officer as may be appointed by the mayor for that purpose, shall cause an investigation to be made, including inspection of the premises where such animals are to be kept, and shall require that the provisions of this article be fully complied with before such permit is issued. Before any permit is issued, the approval of the city sanitarian or city health officer, or the person performing the functions of city sanitarian or health officer, shall be required after he has investigated the matter. 6.15.140 Barns.

All barns or buildings where livestock are kept shall be properly constructed and in good repair, and they must be kept clean at all times. [Ord. 484 § 5, 1970.]

6.15.150 Fences.

All fences must be well-built and kept in good repair at all times. All fences bordering neighboring property must be a minimum of five feet high and of substantial construction. The word “fences,” as used in this section, refers to fences used for the purpose of keeping or containing livestock. [Ord. 484 § 6, 1970.]

6.15.160 General space and care requirements.

There must be a minimum space of 2,000 square feet for each grazing animal such as a horse, cow, mule or other grazing animal, and such grazing area shall not be less than 20 feet wide. [Ord. 484 § 7, 1970.]

6.15.170 Proximity to residences and inhabited buildings.

No person shall keep, use or maintain a livestock barn, corral or enclosure closer than 100 feet to any other person’s residence or inhabited building within the city of Roslyn without written permission from such other person; and such permission must be kept on file with the city clerk and may be revoked by such other person or his successor in interest at any time, and upon revocation the livestock must be removed within seven days. 6.15.180 Hitching or tethering livestock.

No livestock outside of a securely fenced livestock enclosure shall be left within the city of Roslyn without being first securely hitched or tied to a substantial hitching post or structure. No person shall tie, hitch or fasten in any manner any livestock to any shade tree, shrub or bush growing and standing upon the streets, alleys or public places within the city of Roslyn, or without permission upon the property of another person, nor to any light or utility pole or post located upon any street or other public place in the city of Roslyn. 6.15.190 Speed – Riding into building.

No person shall ride or drive any horse, mare, mule, or saddle or work animal of any description in or upon any of the streets or public places within the city of Roslyn faster than an ordinary traveling gait, nor ride or drive any of said animals across or into any sidewalk, park strip, tavern, drinking house, storehouse, business place, or dwelling house within the limits of the city of Roslyn. 6.15.200 Light required at night.

No person shall ride or drive any horse, mare, mule or saddle or work animal of any description upon any street, alley or public place within the city of Roslyn during the hours of darkness without prominently displaying a light upon such animal which is clearly visible from a distance of 300 feet, at least, front and rear, at all times. 6.15.210 Ordinance cumulative.

This article and the regulations thereunder shall be cumulative and in addition to the regulations and requirements of all other ordinances of the city of Roslyn on the same subject. In case of direct conflict, the provisions of this article shall govern over the provisions of any earlier ordinance on the same subject. [Ord. 484 § 12, 1970.]

6.15.220 Additional regulations.

In addition to the requirements and regulations herein set forth, the city sanitarian or health officer shall make such other reasonable rules and regulations from time to time as he may deem necessary to protect the public health and adjoining properties. [Ord. 484 § 13, 1970.]

6.15.230 Revocation of permits.

Any permit issued under this article may be revoked for a violation of the regulations and requirements of applicable city ordinances, or regulations and rules made by the city sanitarian or health officer under authority of this article, if such violations be not corrected within 10 days after a notice has been mailed by certified or registered mail to the permittee. The notice shall specify the violations which are to be corrected. The revocation of permit may be made by the city clerk or other person in charge of issuing such permits or by the city council, and notice of such revocation shall be mailed to the permittee by certified or registered mail, effective upon deposit in the mails. After mailing of such notice of revocation it shall be unlawful for the person to whom the permit was issued or for any person holding under him to keep within the city of Roslyn any of the livestock for which the permit was issued. Any person feeling aggrieved by notice of violation may appear before the city council at the next regular meeting of the city council following mailing of the notice of violation, and be fully heard on the subject. If said next regular meeting of the council is less than two full days after the mailing of notice of violation, the permittee may appear at the second regular council meeting following the mailing of the notice of violation. Failure of the permittee to so appear before the council shall be deemed a waiver of his right to appeal the matter to the city council. [Ord. 484 § 14, 1970.]

6.15.240 Permits – Keeping, mailing, contents, alteration.

All permits issued under this article shall be issued in duplicate and one copy thereof shall be posted in a conspicuous place on the premises where such livestock are to be kept, and one copy shall be kept in the office of the city clerk. Such permits shall describe the premises where the livestock are to be kept, shall set forth the name of the person to whom the permit has been issued, the date of issuance, the mailing address of the person to whom issued (referred to in other portions of this article as the permittee), and the number and description of the livestock for which the permit has been granted. For the purposes of this article, the address stated on such permit shall be deemed sufficient for the mailing of any notices required by this chapter. It shall be unlawful to vary such permit by alteration or modification in any manner without the written approval of the city officer in charge of issuing such permits. It shall be unlawful to keep within the city of Roslyn more livestock than are authorized by such permit. [Ord. 484 § 15, 1970.]

6.15.250 Violations.

Any person, firm or organization violating this chapter shall be subject to the violations and penalties set out in RMC 6.05.180 and 6.05.210 as applicable.
