9.12.010 Offense designated.

Any person, having been released on a promise to appear in the Shelton municipal court on a subsequent court date, or having been released on a personal recognizance with the requirement of a subsequent personal appearance in the Shelton municipal court or having been released after posting bail with the requirement of a subsequent personal appearance in the Shelton Municipal Court, who fails to appear on the date and the time when so required by the court shall be guilty of failure to appear in court regardless of the disposition of the underlying offense. 9.12.020 Violation—Penalty.

Failure to appear in court is a misdemeanor and is punishable by a fine of not less than fifty dollars nor more than one thousand dollars and/or a jail sentence of not more than ninety days. No part of the minimum fine of fifty dollars shall be suspended, waived or deferred nor shall credit toward the fine be allowed for payment of any other costs, fee, fine or assessment which may be or may have been paid to the city or any other agency. Provided, the fifty-dollar fine shall include the required P.S.E.A. Provided further, the fine may be paid through community service if the defendant is eligible for community service and he/she lacks the funds to pay the fine. (Ord. 1283 § 2, 1990)

9.12.030 Alternative penalty.

In the alternative, the judge of the Shelton municipal court shall impose a penalty of not less than fifty dollars nor more than two hundred fifty dollars on the underlying charge for the defendant’s failure to appear in court upon the motion of the prosecuting authority, regardless of the disposition of the underlying charge. No part of the minimum penalty shall be suspended, waived or deferred, nor shall the defendant be allowed credit toward the penalty for payment of any other costs, fee, fine, or assessment which may be or may have been paid to the city of Shelton or any other agency. 9.12.040 Forfeiture of bail or bail bonds—Court powers unaffected.

This chapter shall in no way affect the court’s ability to forfeit bail or bail bonds. (Ord. 1283 § 3, 1990)
