11.40.010 Effective period.
This chapter shall be effective from November 15th of each and every year to March 21st of the following year. (Ord. 1657-1105 (part), 2005: Ord. 1149 § 1, 1984)
11.40.020 Adoption of emergency provision.
Pursuant to the emergency provision of RCW 46.44.080, all city streets are immediately subject to closure for travel by all vehicles exceeding the weight and/or speed limits as listed in this chapter, from November 15th of each year to March 21st of the following year. 11.40.030 Extensions of time period.
The city commissioners may suspend or extend the closure of any city street by independent action according to the prevailing conditions. (Ord. 1657-1105 (part), 2005: Ord. 1149 § 2 (part), 1984)
11.40.040 Resolution of conflicts.
The order codified in this chapter shall supersede, for the period designated, any previous order in conflict herewith. (Ord. 1657-1105 (part), 2005: Ord. 1149 § 2 (part), 1984)
11.40.050 Load restrictions.
The city streets posted with the following load restrictions are closed to all vehicles, the gross weight (vehicle and load) of which exceeds the load limits for the size of tires, as set forth in Table 11.40.050. (Ord. 1657-1105 (part), 2005: Ord. 1149 § 3, 1984)

11.40.060 Posting.
A. In accordance with RCW 46.44.080, the emergency restrictions may be imposed, effective immediately, by posting the roads involved.
B. When imposing load restrictions pursuant to this chapter, the department of public works shall specify and display by posted signs, whichever of the above schedules of load restrictions is necessary to protect the city streets from damage. (Ord. 1657-1105 (part), 2005: Ord. 1149 § 4, 1984)
11.40.070 Allowances—Safety restrictions.
A. No allowance shall be made for any second rear axle suspended from the frame of the vehicle independent of the regular driving axle, otherwise known as “rigid trail” axles. Allowances will be made for single tires only on the front of any truck.
B. The load distribution of any axle of a vehicle shall be such that it will not load the tires on said axles in excess of the prescribed load, as set forth in this chapter. Any loading in excess of the specified maximums as listed herein will be considered a violation of this order. If the motive power for any type of trailer is inadequate to safely handle the specified maximum load as listed herein for such trailer, then in that event, the load on the trailer shall be reduced sufficiently to allow said truck and trailer to operate safely. 11.40.080 Permits allowing transportation along restricted roads.
By general rule of RCW 46.44.080, emergency vehicles on such city streets, which may be closed or restricted shall be exempt. School buses and motor trucks transporting perishable commodities or commodities necessary for the health and welfare of local residents on such city streets, which may be closed or restricted, shall be allowed to operate with a special permit under weight and speed restrictions per RCW 46.44.080. Such permits may include weight and speed restrictions, plus other restrictions deemed necessary to protect the street from undue damage. Fees for permits shall be as established by resolution of the city. (Ord. 1657-1105 (part), 2005: Ord. 1149 § 6, 1984)
11.40.090 Violation—Traffic infraction.
Any violation of these restrictions constitutes an infraction under the provisions of RCW 46.44.080 and 46.44.105. Any person found to have violated any posted limitations of a highway or section of highway shall be assessed the appropriate penalty provided for under RCW 46.44.105. 11.40.100 Civil liability penalty.
Violators are also subject to civil liability for the damage caused by such violations as provided under RCW 46.44.110 and 46.44.120. (Ord. 1657-1105 (part), 2005: Ord. 1149 § 8, 1984)
11.40.110 Posting street closures.
The director of public works or his/her designee for the city of Shelton is delegated the authority, to close any and all city streets from time to time whenever he/she deems it necessary to protect and maintain said streets; but that he/she shall, before closing said city streets, post notices of such closing at each end of said streets, for the purpose of giving due notice to the public of said closure of a street or streets.
