COMPRESSION BRAKES

11.44.010 Prohibited.

Unmuffled compression brakes are prohibited on all city streets; provided further, that no person shall use motor vehicle brakes which are in any way activated or operated by the compression of the engine of any such motor vehicle or any unit or part thereof, unless the braking system is equipped with a functional muffler. It shall be an affirmative defense to prosecution under this section that such compression brakes were applied in an emergency and were necessary for the protection of persons and/or property. 11.44.020 Director of public works—Authorized.

The director of public works is authorized and directed to post appropriate signs consistent with the provisions of this chapter. (Ord. 1722-0108 § 1 (part), 2008: Ord. 1215 § 3, 1987)

11.44.030 Violation—Penalty.

Any person violating the provisions of this chapter shall be subject to the following:

A.  The first offense shall be an infraction with a penalty of one hundred fifty dollars.

B.  The second offense shall be an infraction and shall be a penalty of two hundred fifty dollars.

C.  The third and subsequent offenses shall be considered a misdemeanor and subject to ninety days in jail and/or a one-thousand-dollar fine. (Ord. 1722-0108 § 1 (part), 2008: Ord. 1215 § 2, 1987)
