5.36.010 Permit required.
Whenever any person, group, association, club, business, firm or corporation desires to sponsor any event, as hereinafter defined, such person, group, association, club, business, firm, or corporation shall first obtain an event permit from the city. (Ord. 845 § 1, 1995).
5.36.020 Event defined.
An “event” is any festival, parade, race, dance, celebration or other gathering involving the use of public facilities in the city, including, but not limited to parks, streets, alleys, sidewalks or other city-owned facilities, and which includes a general invitation to all members of the public to either participate in and/or view such event, or part thereof. (Ord. 845 § 2, 1995).
5.36.030 Application contents and fee.
Event permits will be issued only upon the submission of an application therefor which must be filed with the city clerk-treasurer a minimum of 30 days prior to the anticipated date of the event. Such application must contain the following information:
A. A detailed description of the event, including all associated events and/or uses; and the date, or dates, and hours of the event. Event permits are valid from 8:00 a.m. on the beginning date affixed to the face of the permit until 5:00 p.m. on the ending date affixed to the face thereof;
B. A detailed description of the specific area where the event will be held, and, if street closure is requested, a complete listing of such streets or portions thereof, together with the dates and hours of closure;
C. A description of any city services and/or utilities which will be needed;
D. A complete list of any city-owned facilities which will be used;
E. The approximate number of citizens expected to either participate in and/or view the event;
F. The exact name of the person, group, association, club, business, firm or corporation sponsoring said event, together with the complete name, address, and telephone number of the person to contact for all communications from the city;
G. A statement that the sponsor can provide insurance protecting the city from any and all claims and liability arising out of the event;
H. The payment of a $25.00 fee for processing the application. (Ord. 932 § 1, 2000; Ord. 845 § 3, 1995).
5.36.040 Approval of application.
The city clerk-treasurer shall review the permit application and shall issue the permit upon a finding that all of the requirements set forth in this chapter have been satisfied; provided, however, that any permission to discharge fireworks or consume alcohol on city property shall only be granted by the city council. 5.36.050 Issuance of event permit.
The event permit will be issued by the city clerk-treasurer only after the sponsor has presented the clerk-treasurer with a certificate of insurance, with the city named as an additional insured, protecting the city from any and all claims and liabilities arising out of the event, in an amount to be determined by the council. (Ord. 845 § 5, 1995).
5.36.060 Additional services.
All city services and utilities which are required by the event over and above the normal level of service provided to the general public shall be charged to the sponsor at the rates established by ordinance. Where possible, such additional services shall be paid for in advance at the time the permit is issued. Where this is not possible, such services shall be paid promptly upon the receipt of a statement from the city. (Ord. 845 § 6, 1995).
5.36.070 Concession booths and vendors.
The event sponsor shall be in charge of all concession booths and vendors. The sponsor shall determine what booths and vendors shall be allowed, and see that they comply with all ordinances, statutes, rules and regulations, including, but not limited to, public health, safety requirements, and anti-discrimination laws.
