PUBLIC RECORDS – MAINTENANCE – PRODUCTION

2.80.010 Public Records Officer – Appointment and duties.

A. The City Clerk is designated as the Public Records Officer for the City of Sunnyside.

B. The Public Records Officer shall:

1. Serve as a point of contact for members of the public in requesting disclosure of public records;

2. Oversee compliance with the public records disclosure requirements of the public disclosure law of the State of Washington as now or hereafter amended (currently in Chapter 42.56 RCW);

3. Publish his or her name and contact information in a way reasonably calculated to provide notice to the public, including posting at City Hall and other City buildings, posting on the City’s Internet website and inclusion in City publications. [Ord. 2198 § 2, 2008.]

2.80.020 Personnel records.

All personnel records of the City shall be maintained by the Human Resources Office. Access to personnel records shall be in accordance with applicable City personnel policies and collective bargaining agreement provisions. [Ord. 2198 § 2, 2008.]

2.80.030 Fire Department records.

All Fire Department records, with the exception of fire department personnel records, shall be maintained by the Sunnyside Fire Department. Access to Fire Department records shall be in accordance with the policy established by the Sunnyside Fire Department, pursuant to applicable law, including but not limited to (A) laws and regulations pertaining to disclosure of health care information, and (B) Chapter 42.56 RCW, Public Disclosure Act.

The following charges are hereby established for all outside requests to the Sunnyside Fire Department, including ambulance services, for documents and records subject to disclosure:

2.80.040 Police Department records.

All police records, with the exception of Police personnel records, shall be maintained by the Sunnyside Police Department. Access to police records shall be in accordance with the policy established by the Sunnyside Police Department, pursuant to applicable law, including but not limited to (A) Chapter 10.97 RCW, Washington State Criminal Records Privacy Act; (B) applicable regulations; and (C) Chapter 42.56 RCW, Public Disclosure Act. The following charges are hereby established for all outside requests to the Sunnyside Police Department for documents and records subject to disclosure:

2.80.050 Production of records – Schedule of fees.

The following charges are hereby established for all outside requests to City departments, excluding the Police Department and Fire Department, for documents and records subject to disclosure:

2.80.060 Exemptions from copying charge.

In the interest of public service, and to promote public access to calls for service received by the Police Department, the news media, including print and broadcast media, shall be provided, upon request, a copy of the calls for service maintained by the Police Department, without charge and without payment of any copying fee. 2.80.070 Production of records – Applicable law.

All requests for documents and information are subject to the provisions and exemptions under State law, including but not limited to the Public Disclosure Act, Chapter 42.56 RCW, as such now exists or is hereafter amended. [Ord. 2198 § 2, 2008.]
