8.12.130 Emissions of smoke, soot or cinders.

A. No person, firm or corporation, or officer of such corporation, shall operate, or permit to be operated, any boiler, firebox combustion chamber, or other device or thing wherein any fuel of any character is burned or consumed, within the limits of the City, in such a manner as to permit the emission or escape therefrom, either through a smokestack, chimney or other escape device, smoke containing soot, cinders or other solid substances of such character and in such quantities as may cause injury or damage to property within the corporate limits of the City.

B. The emission of smoke containing soot or cinders of such a character and in such quantities as may cause injury or damage to property within the corporate limits of the City, from any boiler, firebox, combustion chamber or other device in which fuel of any character is burned or consumed, within the limits of the City, is declared a public nuisance, and as such may be enjoined or abated by proper action commenced in the courts of the State as are other public nuisances, the provisions of this section being cumulative and in addition to the penalties provided in this code, including but not limited to issuance of notice of civil infraction.
