12.40.010 Permits.

Before any private or nongovernmental sign, placard or other similar device may be placed on any City street, roadway, sidewalk or any other portion of the City’s rights-of-way, the person(s) or organization(s) desiring to install such signs, placards or similar devices shall apply for and receive a permit from the Director of Public Works, which permit shall be granted or denied based upon considerations such as size, design, location, safety, aesthetics, and any other factors affecting the use of the City’s right-of-way. The Director of Public Works shall, further, determine the length of time for which the permit shall be valid, and any considerations or requirements upon which the permit shall be given. 12.40.020 Maintenance.

Prior to issuance of any permit for installation of a private sign on the City’s right-of-way, the person(s) or organization(s) desiring to install such sign, placard or similar device on the City’s right-of-way, shall provide the Director of Public Works with a maintenance schedule, setting forth the frequency and description of efforts by said person(s) or organization(s) in maintaining the sign, placard or similar device and shall, further, provide the Director of Public Works with sufficient information, containing a description of the proposed sign, placard or similar device, including size, proposed location, design, and any other factors affecting safety, aesthetics or use of the right-of-way. It shall be the responsibility of said person(s) or organization(s) to maintain the sign, placard or similar device, and keep the same in a proper state of repair and keep the premises of installation in neat and orderly condition. 12.40.030 Violation.

If the person(s) or organization(s) who have obtained a permit for installation of a sign, placard or similar device, in a public right-of-way, fail to provide maintenance as required by the permit and/or maintenance schedule, or if any person(s) or organization(s) otherwise install any sign, placard or similar device in a City right-of-way, contrary to the provisions of this chapter, the City shall cause such sign, placard or similar device to be removed, with the costs of such removal to be paid by said person(s) or organization(s).
