ABATEMENT OF DANGEROUS BUILDINGS

15.44.010 Uniform Code for the Abatement of Dangerous Buildings.

The edition of the Uniform Code for the Abatement of Dangerous Buildings indicated in SMC 15.02.010 is adopted. [Ord. 1469 § 18, 1984.]

At least one copy of the adopted edition of the Uniform Code for the Abatement of Dangerous Buildings shall be on file in the office of the City Clerk. [Ord. 1469 § 19, 1984; Ord. 1269 § 1, 1980.]

15.44.030 Repair or demolition of damaged buildings.

When a building or structure is damaged, burned or has deteriorated to an extent that the building or structure is not able to be occupied and/or used for the purposes for which the building or structure had been used or for which it reasonably could have been used, then the owner, occupant or person in control of the building or structure shall repair, replace or demolish the building or structure pursuant to permits for such work, within 30 days of the date of notice by the Building Department of the need to repair, replace or demolish such building or structure; provided, that if the building or structure cannot be reasonably repaired, replaced or demolished within said time period, then the Building Department shall have the discretion to grant an extension of time within which the work shall be accomplished of not more than 60 days. It is further provided that this section shall be construed, interpreted and applied as being additional to the Uniform Code for the Abatement of Dangerous Buildings, and this section shall not be construed, interpreted or applied as being a replacement for or a superseding code to the Uniform Code for the Abatement of Dangerous Buildings.

If the owner, occupant or person in control of the building or structure has not complied with the repair or demolition requirements within the time period provided, then the repair or demolition requirements may be enforced in accordance with the provisions for enforcement of orders of the Building Official or the Board of Appeals, in the Uniform Code for the Abatement of Dangerous Buildings and/or the International Building Code.
