10.32.110 Parking requirements.

No person driving or in charge of a motor vehicle shall permit it to stand unattended in any public place, or in any used car or new car lot, or parking lot, without first stopping the engine, locking the ignition, removing the ignition key from the vehicle, setting the brakes thereon or engaging a transmission locking device thereon, and, when standing upon a perceptible grade, turning the front wheels to the curb or side of the street. (Ord. A-617 § 1, 1967).

10.32.120 Liability for violations.

Every person in whose name a vehicle is registered shall be prima facie responsible for any violation of the terms of this chapter. (Ord. A-617 § 2, 1967).

10.32.130 Parking prohibited on designated streets.

It is unlawful for any person to park or to leave stationary, or permit to be parked or left stationary, any vehicle owned by him or in his possession or under his control, upon the following streets, or portions of streets, within the city:

A. South Division Street: On the east side thereof from the point of intersection thereof with East Third Avenue North for a distance of 90 feet;

B. South Date Street: On the southeastern side thereof from the intersection thereof with West First Avenue to the intersection thereof with Washington Avenue;

C. East Third Avenue: On the north side thereof from the intersection with South Division Street east for a distance of 200 feet;

D. South Fir Street: On the northwestern side thereof from the intersection thereof with Jefferson Avenue to the intersection thereof with Madison Avenue;

E. Lincoln Avenue: On the south side thereof from the intersection thereof with Asotin Avenue to the intersection thereof with North A Street, during the hours of 7:00 a.m. through 9:00 p.m. on Monday through Saturday, and from noon until 9:00 p.m. on Sundays, during the period from Memorial Day through Labor Day of each year;

F. North E Street: On the west side thereof from the intersection thereof with East Toppenish Avenue to the intersection thereof with Dayton Avenue;

G. North Chestnut Street: On the east side thereof from the intersection thereof with Asotin Avenue to the northern city limits;

H. North Alder Street: On the western side thereof from the intersection thereof with Chehalis Avenue to the intersection thereof with North D Street;

I. West First Avenue: On the north side thereof from the intersection thereof with the west line of Toppenish Avenue west to the intersection thereof with the east line of Jefferson Avenue and from the intersection thereof with the east line of South Elm

Street east to the intersection thereof with the southwest line of Madison Street, and from the intersection thereof with South Division Street for a distance of 100 feet west; on the south side thereof from the intersection thereof with the west line of South Alder Street west to the intersection thereof with the projection of the east line of South Elm Street, and from the intersection thereof with South Division Street for a distance of 80 feet;

J. South Elm Street, also known as Washington State Route No. 220:

1. That portion along the northwestern side thereof from the intersection with the north line of West First Avenue, also known as State Route No. 220, northeast a distance of 170 feet;

2. That portion along the eastern side thereof from the intersection with the north line of West Second Avenue north to the intersection with the south line of West First Avenue;

K. West Second Avenue: On the south side from the west boundary of the fire department grounds, which is the fence line, eastwardly a distance of 174 feet is a no-parking zone for public vehicles. This zone is restricted to parking by vehicles of volunteer firemen who are present for drill or present to respond to a fire or rescue call; and on the south side thereof from a point which is 44 feet westerly of the west boundary fence of the fire department grounds, thence west to a point which is 61 feet west of the west boundary fence of the fire department grounds; and on the south side thereof from the intersection thereof with Bolin Drive thence east to the alley for a distance of approximately 150 feet;

L. Pearne Street: On the southeast side thereof from the intersection thereof with Lincoln to the intersection thereof with North D Street;

M. North D Street: On the west side from the intersection thereof with Lincoln, north to the intersection thereof with North Beech;

N. South G Street: On the west side from the intersection thereof with East E Street to city limits (Wapenish Road);

O. South Division: On the west side thereof from the intersection thereof with West First for a distance of 100 feet north;

P. South Elm Street and Buena Way (State Route 22): On the east side of South Elm Street beginning 100 feet north of the Jefferson Avenue intersection, thence north on Buena Way and State Route 22 to East McDonald Road; and on the west side thereof from the Franklin Avenue intersection north to Goldendale Avenue; and from the Washington Avenue intersection south along the west side of Buena Way and South Elm Street a distance of 209 feet.

Q. Monroe Avenue: On the west side, from the south edge of the driveway nearest the intersection of Monroe Avenue and west First Avenue, thence north along the west side of Monroe Avenue to the north edge of the driveway nearest the intersection of Monroe Avenue and South Date Street, a distance of approximately 50 feet;

R. Wishkoski Way: On both sides of the street, from its intersection with East Third Avenue thence south a distance of 975 feet;

S. North Beech Street: On the southeast side thereof from the intersection thereof with Dayton Avenue to a point 285 feet northeasterly from said intersection, except that school buses shall be permitted to use said no-parking zone for the purpose of loading and unloading passengers, and except that parking shall not be prohibited in this area on days when school is not in session or after 3:30 p.m. on school days. 10.32.140 Parking of trucks and combinations prohibited on designated streets.

It is unlawful for any person to park or to leave stationary, or permit to be parked or left stationary, any truck, other than the type commonly known as a “pickup truck,” or any combination of motor vehicle and trailer or combination of motor vehicle and semi-trailer, owned by him or in his possession or under his control, upon the following streets, or portions of streets, within the city:

A. Toppenish Avenue, East and South: On both sides thereof from the intersection of East Toppenish Avenue with C Street west and south to the southern city limits;

B. South Alder Street: On both sides thereof from the intersection thereof with West Second Avenue to the intersection thereof with Washington Avenue;

C. Jefferson Avenue: On both sides thereof from the intersection thereof with West First Avenue to the intersection thereof with South Alder Street;

D. West First Avenue: On both sides thereof from the intersection thereof with South Alder Street to the intersection thereof with South Division Street;

E. North Chestnut Street: On both sides thereof from the intersection thereof with Asotin Avenue to the northern city limits;

F. Toppenish Avenue: On the south side thereof from the northeast corner of Block 1, McQuesten’s Second Addition, according to the official plat thereof, west a distance of 150 feet. (Ord. A-629 § 2, 1967; Ord. A-584 § 2, 1964).

10.32.150 Parking of all vehicles prohibited between 3:00 a.m. and 5:00 a.m. where.

It is unlawful for any person to park or to leave stationary, or permit to be parked or left stationary, any vehicle owned by him or in his possession or under his control, upon the following streets, or portions of streets, within the city between the hours of 3:00 a.m. and 5:00 a.m.:

A. South Division Street: On both sides of that portion thereof north of the intersection thereof with West First Avenue;

B. Toppenish Avenue, East and South: On both sides thereof from the intersection of East Toppenish Avenue with North D Street to the intersection of South Toppenish with West Third Avenue; provided, however, that for the part of South Toppenish between West First Avenue and West Second Avenue, parking will be permitted between the hours of 3:00 and 5:00 a.m. on the west side of the street on Tuesdays, Thursdays, and Saturdays and on the East side of the street on Mondays, Wednesdays, and Fridays;

C. South Alder Street: On both sides thereof from the intersection thereof with West Second Avenue to the intersection thereof with Washington Avenue;

D. Washington Avenue: On both sides thereof from the intersection thereof with Toppenish Avenue to the intersection thereof with South Chestnut Street;

E. Jefferson Avenue: On both sides thereof from the intersection thereof with West First Avenue to the intersection thereof with South Beech Street;

F. West First Avenue: On both sides thereof from the intersection thereof with South Alder Street to the intersection thereof with South Division Street;

G. North A Street: On both sides thereof from the intersection thereof with East Toppenish Avenue to the intersection thereof with Lincoln Avenue;

H. North B Street: On both sides thereof from the intersection thereof with East Toppenish Avenue to the intersection thereof with Lincoln Avenue. (Ord. B-258 § 1, 1983; Ord. A-584 § 3, 1964).

10.32.160 Parking of all vehicles prohibited between 7:00 a.m. and 5:00 p.m. on school days where.

It is unlawful for any person to park or to leave stationary, or permit to be parked or left stationary, any vehicle owned by him or in his possession or under his control, upon the following streets or portions of streets within the city between the hours of 7:00 a.m. and 5:00 p.m. on any school day, except during election days:

Madison Avenue: On both sides of that portion thereof from the intersection thereof with South Elm Street to the intersection thereof with South Fir Street. (Ord. B-246 § 4, 1982; Ord. A-651 § 1, 1969).

10.32.170 Two-hour parking permitted when – Locations designated.

It is unlawful for any person to park or to leave stationary, or permit to be parked or left stationary, any vehicle owned by him or in his possession or under his control, upon the following streets, or portions of streets, within the city between the hours of 9:00 a.m. and 6:00 p.m. on all days other than Sundays or legal holidays known as New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day for a period in excess of two hours:

A. Toppenish Avenue, East and South: On both sides from the intersection thereof with C Street to the intersection thereof with West Second Avenue, except for those parking spaces designated as having a 10-minute parking limit in TMC 10.32.180, and except for those parking spaces designated as restricted for taxicab parking only, in TMC 10.32.185;

B. South Alder Street: On both sides thereof from the intersection thereof with Jefferson Avenue to the intersection thereof with Washington Avenue, except as provided in TMC 10.32.180;

C. Washington Avenue: On both sides thereof from the intersection thereof with Toppenish Avenue to the intersection thereof with South Alder Street;

D. Jefferson Avenue: On the northeastern side thereof from the intersection thereof with West First Avenue to the intersection with alley adjacent to the post office;

E. West First Avenue: On the north side thereof from the intersection thereof with South Alder Street to the intersection thereof with South Beech and from the intersection thereof with South Toppenish Avenue to Division Street; on the south side thereof from South Toppenish Avenue to the intersection thereof with South Alder Street and from a point 80 feet west of the intersection thereof with South Division Street west to a point which is 20 feet east of the intersection thereof with South Toppenish Avenue. 10.32.180 Ten-minute parking limit established where.

It is unlawful for any person to park or to leave stationary, or permit to be parked or left stationary, any vehicle owned by him or in his possession or under his control, upon the following streets, or portions of streets, within the city between the hours of 9:00 a.m. and 6:00 p.m. for a period in excess of 10 minutes:

A. Toppenish Avenue:

1. On the southeastern side thereof from the intersection thereof with West First Avenue for 100 feet from the north curbline of West First Avenue;

2. On the southeastern side thereof, the two parking spaces adjacent to address numbers 20 – 22, Toppenish Avenue, in front of the Pix Theatre;

3. On the west side of South Toppenish Avenue (South of West First Avenue), the two parking spaces adjacent to address number 213 South Toppenish Avenue, in front of the Liberty Theatre;

4. On the west side of South Toppenish Avenue, the two parking spaces adjacent to 323 South Toppenish Avenue;

B. South Alder Street: On the southeastern side thereof from the intersection thereof with Jefferson Avenue to the line common to Lots 14 and 15, Block 3, Gilbert’s Addition to Toppenish;

C. Jefferson Avenue: On the northeastern side thereof from the intersection thereof with South Alder Street to the intersection thereof with alley adjacent to post office;

D. South Alder Street: On the northeastern side thereof, two parking spaces adjacent to 11 South Alder;

E. Washington Avenue: On the southwesterly side thereof, between East Toppenish and South Alder, one parking space 25 feet northwest of the alley as designated by the police chief;

F. South Elm: On the northwesterly side thereof for a distance of 50 feet northeast from the northeasterly line of the intersection thereof with Madison;

G. West First Avenue: On the north side thereof for a distance of 80 feet east from the east line of the intersection thereof with Toppenish Avenue on the south side thereof from the intersection of West First Avenue and South Toppenish Avenue, easterly a distance of 20 feet;

H. West Second Avenue: On the south side thereof from the west boundary of the fire department grounds, which is the fence, thence west a distance of 44 feet;

I. West Second Avenue: On the south side thereof from the west edge of the alley running north and south between South Alder Street and South Toppenish Avenue thence west a distance of 80 feet, being the portion of West Second Avenue adjacent to 210 West Second Avenue. 10.32.185 Restricted parking – Taxicab parking only.

Other than for clearly marked and identified taxicab vehicles, it is unlawful for any person to park or to leave stationary, or to permit to be parked or left stationary, any vehicle owned by him or in his control or in his possession, upon the following portions of streets:

A. South Alder Street: On the west side thereof, a parking space between West First Avenue and Jefferson Avenue, in such place as shall be designated by the chief of police, and marked by a sign indicating that said space is restricted to parking by taxicab only. (Ord. 90-3 § 1, 1990; Ord. B-330 § 3, 1984).

10.32.186 Restricted parking – Horse trolley parking only.

Other than for clearly marked and identified horse trolleys it is unlawful for any person to park or to leave stationary, or to permit to be parked or left stationary, any vehicle owned by him or in his control or in his possession, upon any portions of streets in such place as shall be designated by the city council with advice of the chief of police and public works director and marked by a sign indicating that said space is restricted to parking by horse trolleys only. (Ord. 92-14 § 1, 1992).

10.32.187 Restricted parking for volunteers working at the Toppenish Visitor Center.

Monday through Friday of every week, between the hours of 8:00 a.m. and 5:00 p.m., other than for persons volunteering to work at the Toppenish Visitor Center, it is unlawful for any person to park or to leave stationary, or to permit to be parked or left stationary, any vehicle owned by him/her or in his/her control or in his/her possession, within the two parking spaces in front of the Visitor Center that are immediately adjacent to and to the right of the handicapped parking spot there. A sign shall be posted at each space to give public notice of these restrictions. (Ord. 2014-6, 2014).

10.32.190 Angle parking – Required where.

Where parking is not otherwise prohibited, either as to location, time or type of vehicle, vehicles shall be parked parallel with the curb or side of street upon all streets in the city with the exception of the following described streets or portions of streets where vehicles shall be parked at an angle of approximately 45 degrees to the curb or side of street with the right front wheel of such vehicle touching the curb or side of street:

A. Toppenish Avenue: On both sides thereof from the intersection thereof with West Third Avenue to the intersection thereof with West First Avenue;

B. South Alder Street:

1. On the northwestern side thereof from the intersection thereof with West First Avenue to the intersection thereof with Washington Avenue,

2. On the southeastern side thereof from the intersection thereof with West First Avenue to the intersection thereof with Jefferson Avenue;

C. North Beech Street: On the northwestern side thereof from the intersection thereof with Chehalis Avenue to the intersection thereof with Dayton Avenue; and on the northeastern side thereof from a point 285 feet northeasterly from the intersection thereof with Dayton Avenue to the intersection thereof with Ellensburg Avenue;

D. Washington Avenue: On the northeastern side thereof from the intersection thereof with Toppenish Avenue to the intersection thereof with the southeastern boundary of South Beech Street as extended across Washington Avenue. 10.32.195 Parking in front of mailboxes prohibited.

Except when necessary to avoid conflict with other traffic, or in compliance with law or the directions of a police officer or official traffic control device, no person shall stop, stand or park a vehicle directly adjacent to curbside, clearly visible residential mailboxes between 9:30 a.m. and 3:30 p.m. on all days except Sundays and holidays. (Ord. 90-2 § 1, 1990).

10.32.200 Provisions not exclusive.

Repealed by Ord. 99-3. (Ord. A-584 § 7, 1964).

10.32.210 Violation – Penalty.

Any person violating any of the provisions of this chapter shall have committed a civil infraction, punishable by a fine not to exceed $30.00. The procedures for the issuance of the civil infraction citation, the recipient’s rights to contest the finding that the infraction was committed, and all other procedures applicable to civil infractions shall be as set forth in Chapter 2.90 TMC.
