MISCELLANEOUS TRAFFIC REGULATIONS*

10.36.010 Parades and miscellaneous street closures – Signs.

A. Parades. It is unlawful for any person or persons, society, association or organization (hereinafter referred to as “persons”) to parade upon any street, alley, avenue or other public place in the city without having the prior consent of the city to conduct the parade.

1. Persons desiring to obtain consent for a parade must deliver written application therefor to the city manager, at least 15 business days before the parade is scheduled. This time requirement may be lessened or entirely waived, at the joint discretion of the city manager and the chief of police.

2. The application shall state the purpose of such parade, the place and hour of formation, the proposed route of the parade, and the name or names of the person or persons and organization sponsoring or having charge or control of the parade.

3. The chief of police may in his discretion direct the place of formation and the route of the parade, as public traffic and safety may require, and with the approval of the city manager, he may forbid or stop any such parade whenever deemed necessary for the preservation of the public peace.

4. The city manager shall notify the city council about the parade as soon as reasonably possible after receipt of the application.

B. Miscellaneous Street Closures. It is unlawful for any person or persons, society, association or organization to close any street, alley, avenue or other public place in the city without having the prior consent of the city. Said closures may be authorized or directed by the public works director for such purposes as street or sewer or water main repairs; and by the chief of police for public health and safety purposes or for such purposes as block parties, peaceful demonstrations, exhibits, or other events which the police chief shall deem reasonable.

C. Signs. Upon approval of any closure as set forth above, the city shall take appropriate action to provide and place suitable warning signs and devices in or near the roadway for the protection of the public and to ensure the prevention of normal traffic flows on the closed area. No person shall drive a motor vehicle upon any closed street or portion thereof except persons having businesses or residences along the closed area, and then only as may be reasonably necessary and in a manner that will not obstruct a parade or other activity in progress. 10.36.050 U-turns and driving over, across or within a solid yellow median strip not less than 18 inches wide on South Toppenish Avenue between Second Avenue and Washington Avenue prohibited.

The driver of any vehicle on South Toppenish Avenue between Second Avenue and Washington Avenue shall not make a U-turn by turning such vehicle so as to proceed in the opposite direction, or drive such vehicle over, across or within the 18-inch or wider solid yellow strip that divides opposite lanes of traffic. Every vehicle operator shall drive only upon the right-hand roadway unless directed or permitted to use another roadway by official traffic control devices or police officers. Until midnight between November 30, 2009, and December 1, 2009, violators shall be issued warnings only. (Ord. 2009-13 § 1, 2009).

10.36.060 Violation – Penalty.

Any person who violates or fails to comply with any of the provisions of this chapter, or who counsels, aids or abets any such violation or failure to comply, shall be deemed to have committed a civil infraction, punishable as set forth in Chapter 2.90 TMC, Civil Infractions.
