18.02.010 Interpretation of text.

In interpreting and applying the provisions of this title, these provisions shall be held to be the minimum requirements adopted for the promotion of the public health, safety or general welfare. Whenever the requirements of this title differ from the requirements of any other laws, ordinances, regulations or codes, the most restrictive shall apply. Regardless of any other provisions of this title, no land shall be used and no structure erected or maintained in violation of any state or federal pollution control or environmental protection law or regulation.

18.02.020 Interpretation of zoning boundaries.

Where uncertainty exists as to any of the zone boundaries as shown on the zoning map, the following rules shall apply:

A.    Where such boundaries are indicated as approximately following the centerline of roads, streets, highways, alleys, railroads or rivers, the centerline shall be construed to be such boundaries.

B.    Where such boundaries are indicated as approximately following lot lines, the lot lines shall be construed to be such boundaries.

C.    In unsubdivided land and where a zone boundary divides an ownership, the location of the boundary, unless it is indicated by dimensions shown on the map, shall be determined by the scale measurement.

18.02.030 Application outside city limits.

A.    All provisions of this title shall apply within the Tumwater urban growth area (as defined in the 1995 Tumwater/Thurston County Joint Comprehensive Plan, as amended), except for the following:

1.    TMC Chapter 18.38, FP Floodplain Overlay;

2.    TMC Chapter 18.39, AQP Aquifer Protection Overlay;

3.    TMC Chapter 18.40 (TMC 18.40.010 through 18.40.050 only), Environmental Performance Standards;

4.    TMC Chapter 18.48 (TMC 18.48.010 through 18.48.100 only), Manufactured Homes.

B.    All provisions of the Thurston County Code, except the Thurston County zoning ordinance, shall continue to apply within the urban growth area, including but not limited to the Thurston County right-to-farm, right-to-practice forestry, and critical areas ordinances.
