18.64.010 Administration official – Enforcement powers and duties.

The administrative official or his/her designated representatives shall administer and enforce the provisions of this title. It shall be the duty of the administrative official to coordinate the administration of this title with present and future planning documents having jurisdiction in the city and to see that all structures conform to all provisions of this title. If the administrative official finds that any of the provisions of this title are being violated, he/she shall notify in writing the person responsible for such violation, indicating the nature of the violation and ordering the action necessary to correct it. He/she shall take any action necessary by this title to ensure compliance with or to prevent violation of its provisions.

18.64.020 Violation – Penalty.

A.    Violations of the provisions of this title, or failure to comply with any of its requirements, shall constitute a misdemeanor. In addition, violators shall pay all costs and expenses involved in the case subject to the requirements of TMC Chapter 1.10, Civil Enforcement of Code, and/or TMC Chapter 1.12, Criminal Enforcement of Code. Each day such violation continues shall be considered a separate and distinct offense.

B.    The tenant or occupant of any building, structure, premises or part thereof, and any architect, builder, contractor, agent, owner, or other person who commits, participates in, assists in, or maintains such violation may be found guilty of a separate offense. Nothing in this chapter shall prevent the city from taking any other legal remedy authorized by law.
