6.12.010 Running at large prohibited.

It is declared to be unlawful for any domestic animal to run at large within the corporate limits of the town, and the running at large of any domestic animal within the corporate limits of the town is hereby prohibited; provided, that nothing herein contained shall be construed to include any cat. (Ord. 563 § 23, 1996; Ord. 23 § 1; Ord. 21 § 1, 1902).

6.12.020 Marshal designated poundkeeper – Pound established.

The town marshal or other designee of the town shall be ex officio poundkeeper in the town and a common pound shall be established and maintained at the discretion of the town council. (Ord. 563 § 24, 1996; Ord. 21 § 2, 1902).

6.12.030 Impoundment authorized – Sale of impounded animals.

It is made the duty of the town marshal to impound in the common pound all estray domestic animals, except dogs, found within the town and to impound all domestic animals except dogs, found running at large within the corporate limits of the town, and to keep all such animals so impounded for the space of seven days from the time of impounding the same, unless such animal or animals shall be sooner redeemed by the payment of the fees and charges fixed in this chapter and the marshal, as soon as he shall impound any such animal, he shall immediately advertise such impounded animal for sale and shall give notice of such sale by posting a notice of such sale in three of the most public places in the town for at least six days prior to such sale and shall recite in such notices a description of such animal or animals and the time and place of sale, and all such sales shall be at public auction to the highest bidder for cash. 6.12.040 Impoundment fees – Sale of animals authorized when.

It shall be the duty of the marshal to collect the sum of $100.00 for the first day or fraction of the first day for every animal impounded and the sum of $50.00 for each and every additional day or fraction of a day that any such animal shall be so impounded, and if any such animal shall not be redeemed by the payment of such fees and charges, the same shall be sold as set forth in this chapter, and after deducting the cost of keeping any such animal, the marshal shall place the balance of the amount arising from such sale in the town treasury for the benefit of the owner of such animal if demanded within one year from the date of such sale. 6.12.050 Interference with pound prohibited – Penalty.
