10.34.010 Definitions.

“Motorized foot scooter” means a device with no more than two 10-inch or smaller diameter wheels that has handlebars, is designed to be stood or sat upon by the operator, and is powered by an internal combustion engine or electric motor that is capable of propelling the device with or without human propulsion. (Ord. 644 § 1, 2004).

10.34.020 Motorized foot scooters.

A. It is unlawful to operate or ride a motorized foot scooter within Pioneer Park and on vacated West Walnut Street running through Pioneer Park where it borders Lots 13 – 24, Block 5, and Lots 1 – 12, Block 8, Waterville Original, Waterville, Washington.

B. It is unlawful to operate or ride a motorized foot scooter upon any sidewalk within the town of Waterville.

C. Every motorized foot scooter upon a public way within the town of Waterville at any time from a half hour after sunset to a half hour before sunrise and at any time when, due to insufficient light or unfavorable atmospheric conditions, persons and vehicles on the public way are not clearly discernable at a distance of 1,000 feet ahead shall display a headlight, lighted stop light, lighted turn signals, and at least two illuminating reflectors.

D. Operation of a motorized foot scooter shall comply with the rules of the road applicable to motorized automobiles, motorcycles, and bicycles.

E. Operation of a motorized foot scooter without wearing a properly fitted and fastened bicycle helmet that meets or exceeds the standards of either the American Society for Testing and Materials (ASTM) or the United States Consumer Product Safety Commission (CPSC) or standards subsequently established by those entities, is unlawful.

F. Operation of a motorized foot scooter without a muffling device, or operation with a modified muffling device, is unlawful. (Ord. 644 § 2, 2004).

10.34.030 Violation – Penalty.

Any person violating any provision of WMC 10.34.020 shall be guilty of an infraction and shall be punished by the imposition of a monetary penalty of not more than $25.00 for the first violation, of not more than $50.00 for a second violation, and not more than $100.00 for each subsequent violation.
