9.64.010 Definitions.

Unless the context requires otherwise, the following means:

(1) Esplanade. For purposes of this chapter, the “Esplanade” is defined as that area of sidewalk between Dock Street along Westhaven Drive west to Cove Street adjacent to the breakwater.

(2) Skateboarding. For the purposes of this chapter, whenever the word “skateboarding” is used, it shall also include coaster, roller skates, roller blades or other similar devices.

(3) The word “operate” as used in this chapter has its ordinary meaning except that it does not apply to carrying or walking alongside said devices. (Ord. 1284 § 1, 2003; Ord. 972 § 1, 1994)

9.64.020 Skateboarding prohibited along Westhaven Drive.

(1) It is unlawful for any person to operate a skateboard, coaster, roller skates, roller blades or similar devices along the Esplanade between Dock Street and Cove Street. Bicycles may be operated along the Esplanade between Dock Street and Cove Street in a manner not to interfere with pedestrians using the Esplanade.

(2) It is unlawful for any person to operate a bicycle, skateboard, coaster, roller skates, roller blades or similar devices along the sidewalk on the south side of Westhaven Drive between Dock Street and Cove Street adjacent to the businesses in the dock area. 9.64.030 Negligent operation of skateboards prohibited.

It is unlawful for any person to operate a skateboard, bicycle, coaster, roller skates, roller blades or similar devices in a negligent manner upon any city-owned roadway, sidewalk or publicly owned parking lot within the city limits of Westport. For purposes of this section, “to operate in a negligent manner” means the operation of a skateboard or similar devices, in such a manner as to endanger or be likely to endanger any persons or property. 9.64.040 Parent responsibility.

(1) It is unlawful for any parent, guardian or other person having control of a minor child to allow said minor child to operate a skateboard or other similar device in violation of this chapter.

(2) Should a minor child violate the provisions of this chapter more than once, the parent, guardian or other person having control of said juvenile shall be guilty of a misdemeanor punishable pursuant to WMC 9.64.070. (Ord. 1284 § 4, 2003; Ord. 972 § 4, 1994)

9.64.050 Regulation not applicable to wheelchairs.

This chapter does not apply to wheelchairs and/or other related devices necessary for a person to be ambulatory. (Ord. 1284 § 5, 2003; Ord. 972 § 5, 1994)

9.64.060 Regulation not applicable to the Westport Lighthouse Trail System.

(1) It is unlawful to operate a skateboard, bicycle, coaster, roller skates, roller blades or similar device in a negligent manner as defined in WMC 9.64.030 on the walkway known as the Westport Lighthouse Trail System extending from Ocean Avenue north to the State Park.

(2) Whenever a person is riding a skateboard or similar device along the Westport Lighthouse Trail System, that person shall yield the right-of-way to any pedestrian or wheelchair bound person as not to interfere with that person’s direction. (Ord. 1284 § 6, 2003; Ord. 972 § 6, 1994)

9.64.070 Violation and penalty.

Any person violating any provisions of this chapter shall be guilty of a civil infraction, and upon conviction thereof, shall be assessed a monetary penalty of not more than $250.00. Community service hours may be imposed in lieu of a monetary penalty. (Ord. 1284 § 7, 2003; Ord. 972 § 7, 1994)

9.64.080 Remedies not exclusive.

The remedies prescribed in this chapter are in addition to all other remedies provided or authorized by law. (Ord. 1284 § 8, 2003; Ord. 972 § 8, 1994)
