10.10.010 Definitions.

As used in this chapter:

“City streets” shall mean every public street, road, alley and right-of-way, or part thereof, maintained by the city, lying inside the city limits of the city of Westport, and which has not been designated as a state highway as that term is defined in RCW 46.04.560 as now or hereafter amended.

“Commercial vehicles” shall mean any combination consisting of a truck and trailer, tractor and trailer, combination of three vehicles, or combination consisting of a tractor and stinger-steered semi-trailer combination.

“Compression brakes” means a mechanical device that utilizes the compression of the vehicle’s engine to retard the forward motion of a heavy vehicle. This definition includes, but is not limited to, the terms “exhaust brakes” or “jake brakes.”

“Construction and commercial truck” shall mean any three or greater axle vehicle, any dual-axle tandem, dual rear tire vehicle or vehicle with a manufacturer’s gross vehicle weight (GVW) rating greater than 10,000 pounds.

“Local delivery” shall mean construction or commercial trucks delivering or receiving goods, materials, equipment or services within the residential and commercial area or along residential or collector streets of the city. “Local delivery” includes, but is not limited to, moving vans, retail delivery trucks, trucks delivering goods or services within the commercial or business district and private residential services, such as lawn care services, construction and landscaping material delivery and home improvement services.

“Through hauling” shall mean any vehicle traveling through the city without planned stops for delivering, receiving or exchanging of goods, materials or equipment.

“Truck route” shall mean any route designated for use as heavy vehicle routes within the city.

Vehicle, Heavy. “Heavy vehicle,” as used in this chapter, means any vehicle, motor vehicle, truck, truck tractor, trailer or semi-trailer or a combination thereof having a gross weight in excess of or licensed for 18,000 pounds. This does not include self-propelled recreational vehicles or motor homes.

“Weight limit” shall mean the total vehicle weight limitation allowed on residential and collector streets as defined in this chapter. (Ord. 1646, 2021)

10.10.020 Heavy vehicle – Prohibited use – Designated.

From and after the effective date of the ordinance codified in this chapter, it is unlawful to operate, drive, move, tow, park, or in any way propel any heavy vehicle over, along, upon, or across any street in the city, except those streets designated in WMC 10.10.050 or as otherwise allowed in this chapter. No heavy vehicle resting on dollies shall be parked on any street without pads at least 12 inches by 12 inches being placed under the dollies. (Ord. 1646, 2021)

10.10.030 Heavy vehicle – Prohibited use – Exceptions.

The limitations set forth in WMC 10.10.020 shall not apply to the following:

(1) Commercial vehicles while engaged in local deliveries to businesses and homes within the city limits.

(2) Utility vehicles servicing utilities within the city limits.

(3) Local garbage collector vehicles operating within the city limits.

(4) Construction vehicles may operate within the city limits; however, the owners shall be responsible for wheel rut repairs and/or other damage resulting to streets traveled by construction equipment to the city of Westport and as provided for in RCW 46.44.110 and 46.44.120.

(5) Municipal vehicles of the city of Westport.

(6) School buses.

(7) Vehicles approved by the city used in parades.

(8) Mail trucks.

(9) Certified emergency vehicles. (Ord. 1646, 2021)

10.10.040 Compression brakes.

(1) No person shall operate a compression brake device on any heavy vehicle within the city limits.

(2) It shall be an affirmative defense of prosecution under this section that the compression brakes were applied in an emergency and were necessary for the protection of persons and/or property.

(3) This section shall not apply to emergency vehicles. (Ord. 1646, 2021)

10.10.050 Truck routes.

The following streets are designated as heavy vehicle routes within the city:

(1) State Route 105 Spur which includes the following city streets:

(A) South Forrest Street from southern city limits to Ocean Avenue; and

(B) Ocean Avenue from south Forrest Street to Montesano Street; and

(C) North Montesano Street to the terminus of SR 105 Spur at the intersection of Dock Street and Westhaven Drive. (Ord. 1646, 2021)

10.10.060 Route posting.

The streets designated as the “truck route” shall be marked with signs in an appropriate manner. (Ord. 1646, 2021)

10.10.070 Penalties for violation.

Violation of any of the provisions of this chapter is a traffic infraction and shall be assessed a basic penalty of not less than $100.00 for the first offense, $200.00 for the second offense and $400.00 for the third offense. (Ord. 1646, 2021)

10.10.080 Severability.

If any section, sentence, clause, or phrase of this chapter should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this chapter.
