15.08.010 Required on certain rented or leased occupancies.

Smoke detectors shall be installed and maintained in accordance with the provisions of this chapter in the following occupancies that are rented, leased or let to a person, persons, or corporation:

(1) Guest rooms and dwellings in hotels, motels, apartments and condominiums and similar or other uses as defined in Group R, Division 1, Occupancies of the Uniform Building Code, 1976 Edition, and as may be amended by the 1979 Edition.

(2) Dwelling units in duplexes, single-family dwellings and lodging houses or other uses as more particularly defined in Group R, Division 3, Occupancies of the Uniform Building Code, 1976 Edition, and as may be amended by the 1979 Edition.

(3) Mobile dwelling units. (Ord. 595 § 1, 1979)

15.08.020 Installation required by January 30, 1981.

Smoke detectors required by this chapter shall be installed in all occupancies listed in WMC 15.08.010 by no later than January 30, 1981. (Ord. 595 § 5, 1979)

15.08.030 Conformance or approval required.

Smoke detectors installed in accordance with the provisions of this chapter shall be of a type conforming to Uniform Building Code Standard 43-6 or of a type approved by the city director of public works. (Ord. 595 § 2, 1979)

15.08.040 Installation requirements.

The method of installation of smoke detectors shall be in accordance with the provisions of the 1976 Edition of the Uniform Building Code, and as may be amended by the 1979 Edition, Section 1310 for hotels, motels, apartments and condominiums and Section 1413 for duplexes, single-family dwellings, lodging houses and mobile homes.

(1) The building owner and agent shall be responsible for the installation.

(2) The building owner and agent shall provide or post within each guest room or dwelling unit, written operating instructions and maintenance instructions for the smoke detector installed therein.

(3) A no-fee permit shall be required for the installation of smoke detectors. Said permit may be obtained at the fire marshal/building department, City Hall. (Ord. 595 § 3, 1979)

15.08.050 Maintenance responsibility.

Maintenance of smoke detectors shall be the responsibility of the tenant who shall maintain the device in accordance with the instructions of the manufacturer. When an occupancy is vacated, the building owner or agent shall ensure that smoke detectors are operational prior to reoccupancy. (Ord. 595 § 4, 1979)

15.08.060 Penalty for violation.

Any person violating any provision of this chapter is guilty of a misdemeanor and upon conviction thereof, punished by a fine of not more than $300.00 or by imprisonment for not more than 90 days, or by both such fine and imprisonment. (Ord. 595 § 6, 1979)
