17.12.010 Classifications designated.

In order to accomplish the purpose of this title, the following use classifications are established, in which regulations are prescribed concerning the permissible uses, conditional uses, lot, density and yard requirements and building and off-street parking requirements.

Primary district:

Residential or “R” districts R-1 and R-2;

Ocean beach residential or “OBR” districts OBR I and OBR II;

Tourist commercial or “TC” district;

Mixed use/tourist commercial or “MUTC” districts MUTC-1 and MUTC-2;

Marine industrial or “MI” district;

Recreation and parks or “RP” district;

17.12.020 Zoning map.

The location and boundaries of the various zones are such as are shown and delineated on the city zoning map entitled “City of Westport Comprehensive Land Use, Shoreline, and Zoning Map” dated July 9, 2013, as it currently exists or is hereinafter amended, which is adopted as part of this title. Changes in the boundaries of the zones constitute an amendment to this title and such amendments shall be made by ordinance, following the process set forth in Chapter 17.48 WMC. A reproducible copy of the zoning map shall be maintained by the administrator and shall be changed to reflect all amendments. The zoning map may, for convenience, be divided into parts and such parts may be separately employed for identification purposes when adopting or amending the zoning map or for any official reference to the zoning map. 17.12.030 Uncertainty of boundaries.

(1) Where such boundaries are indicated as approximately following street or alley lines or lot lines, such lines shall be construed to be such boundaries;

(2) In the case of unsubdivided property, and where a zone boundary divides such property, the location of such boundaries, unless the same are indicated by dimensions, shall be determined by the use of the sale appearing on said zoning map;

(3) Where a public street or alley is officially vacated, the area thereof shall acquire the classification of the property to which it reverts;

(4) Where a zone boundary is shown on the map as a street, alley, waterway, or railroad, the boundary shall be the centerline of the street, alley, water or railroad;

(5) Where the shoreland jurisdiction boundary is based on a shoreline delineation, the precise location of the boundary may be determined by delineation performed by a qualified expert and approved by the Washington State Department of Ecology. (Ord. 1146 § 2, 1998)

17.12.040 Interpretation.

In interpreting and applying the provisions of this title, they shall be held to be minimum requirements adopted for the promotion of the public health, safety, and general welfare. Except as specifically herein provided, it is not intended by this title to repeal, abrogate, annul, or in any way to impair or interfere with any existing provision of law, regulation, or permit previously adopted or issued, or which shall be adopted or issued pursuant to law, relating to the use of buildings or land or relating to the erection, construction, establishment, moving, alteration, or enlargement of any building or improvement, nor is it intended to interfere with or abrogate or annul any easement, covenant, or other agreement between parties; provided, that whenever this title imposes greater restriction upon the erection, construction, establishment, moving, alteration, or enlargement of buildings, or the use of any building, or of any land in any of the districts established by this title, than are imposed or required by such existing provisions of law or regulations, or permits, or easements, or covenants, or agreements, then the provisions of this title shall control. 17.12.050 Limitation of land use.

Except as provided in this title, no building or structure shall be erected, reconstructed or structurally altered, nor shall any building, structure, or land be used for any purpose except as hereinafter specifically provided and allowed in the zone in which such building, structure or land is located.
