2.24.010 Established.

There is hereby established a boundary review board for Whatcom County created pursuant to RCW 36.93.030. (Res. dated 12/28/77 § 1; prior code § 1.60.1).

2.24.020 Powers granted.

Such board is to be known as the Whatcom County boundary review board, to have and exercise those powers granted to boards for counties other than class AA counties, under RCW Chapter 36.93. (Res. dated 12/28/77 § 2; prior code § 1.60.2).

2.24.030 Members – Number.

The Whatcom County boundary review board shall consist of five members selected by the governor from nominees filed with the office of the governor, as provided in RCW 36.93.060. (Res. dated 12/28/77 § 3; prior code § 1.60.3).

2.24.040 Members – Selection.

Members of the board shall be selected as follows:

A. Two by the Governor, independently;

B. One from nominees of the individual mayors of the cities and towns within Whatcom County;

C. One from nominees by the executive, confirmed by the Whatcom County council, as per Whatcom County Home Rule Charter 3.23; and

D. One from nominees of each special purpose district lying wholly or partly within Whatcom County. (Ord. 93-048 (part); Res. dated 12/28/77 § 4; prior code § 1.60.4).

2.24.050 Vacancies.

Vacancies on the board shall be filled within 30 days of the vacancy. Nominations to fill vacancies caused by expiration of terms shall be filed at least 30 days preceding the expiration of the terms. Each source shall nominate at least two persons for every available position. In the event that there are less than two nominees for any position, the governor may appoint the member for that position independently. (Res. dated 12/28/77 § 5; prior code § 1.60.5).

2.24.060 Members not to be consultants.

No member shall be consultant or adviser on a contractual or regular retaining basis of the state, or of any municipal corporation thereof within Whatcom County. (Res. dated 12/28/77 § 6; prior code § 1.60.6).

2.24.070 Board not to meet in panels.

The Whatcom County boundary review board shall not meet in panels. (Res. dated 12/28/77 § 7; prior code § 1.60.7).

2.24.080 Organization.

The board shall organize and operate as generally provided in RCW Chapter 36.93. (Res. dated 12/28/77 § 8; prior code § 1.60.8).

2.24.090 Election of officers – Rules of procedure.

A. The members of each boundary review board shall elect from its members a chairman, vice-chairman and shall select a nonmember as chief clerk, who shall be the secretary of the board.

B. The board shall determine its own rules and order of business and shall provide by resolution for the time and manner of holding all regular or special meetings, and shall keep a journal of its proceedings which shall be a public record. A majority of all the members shall constitute a quorum for the transaction of business. (Res. dated 12/28/77 § 9; prior code § 1.60.9).

2.24.100 Powers of chief clerk.

As empowered by virtue of RCW 36.93.070, the chief clerk of the board shall have the power to administer oaths and affirmations, certify to all official acts, issue subpoenas to any public officer or employee ordering him to testify before the board and produce public records, papers, books or documents. The chief clerk may invoke the aid of any court of competent jurisdiction to carry out such powers. (Res. dated 12/28/77 § 10; prior code § 1.60.10).
