9.15.010 Discharge of firearms or other dangerous instruments.

It is unlawful for any person, except an officer of the law in the line of duty, to discharge any firearm, including multi-pump and CO2 cartridge air guns, thirty-five (35) pounds and more bow and arrow, or any instrument of similar character, within the Town limits of the Town of Wilkeson. Any violation of this section is a misdemeanor. Any weapon so used may be confiscated by the arresting officer or the court and upon conviction of a violation of this section, the weapon may be permanently confiscated and become the property of the Town. 9.15.020 Possession of firearms – Violation.

A. It is unlawful to possess a firearm in a Town vehicle or Town building. A firearm shall be as defined pursuant to State law.

B. A violation of this section shall constitute a misdemeanor and penalized as set forth in the misdemeanor section of the general penalty ordinance for the Town. [Ord. 97.12 §§ 1, 2, 1997].

9.15.030 Disposal of firearms.

A. Except as provided in subsection (C) of this section, all firearms which are or have been either (1) judicially forfeited to the Town after June 30, 1993, and are no longer needed for evidence or (2) forfeited to the Town after June 30, 1993, due to a failure to make a claim under RCW 63.32.010 or 63.42.010, may be either retained by the Police Department for official use or be destroyed. The Town Marshal is hereby authorized and directed to either arrange for the destruction of said firearms or retain the same for official use.

B. Except for those firearms described in subsection (C) of this section, all firearms which were (1) judicially forfeited to the Town on or before June 30, 1993, and are no longer needed for evidence, or (2) forfeited to the Town on or before June 30, 1993, due to a failure to make a claim under RCW 63.32.010 or 63.40.010, shall be disposed of by destruction, in the case of illegal firearms, or be traded or auctioned in the case of all other firearms, as provided in RCW 9.41.098.

C. Antique firearms as defined by RCW 9.41.150 and firearms recognized as curios, relics, and firearms of particular historical significance by the United States Treasury Department Bureau of Alcohol, Tobacco, and Firearms are exempt from destruction and shall be disposed of by auction or trade to commercial sellers.
