2.36.010 Definitions.

As used in this chapter the words “municipal corporation,” “fire department,” “firemen,” “performance of duty,” “State Board,” shall have the same definition and meaning as set forth in RCW 41.24.010, as amended, which said RCW 41.24.010 is, in its entirety, adopted and made a part of this chapter the same as if herein set forth in full. 2.36.020 Enrollment.

A. In accordance with the provisions of RCW 41.24.020 any fireman serving in the fire department of the town may, at the option of the individual fireman and subject to the rules and regulations promulgated by the State Board, enroll under the pension provisions of Chapter 41.24 RCW, and thereby elect to avail himself of the retirement benefits therein provided.

B. The collection and payment of fees as required by said Chapter 41.24 RCW shall be provided for in subsection C of this section.

C. The town clerk and the chief of the town fire department are authorized and directed, within the provisions of this chapter, to enroll all members of said fire department under the provisions of Chapter 41.24 RCW, for the purposes provided in RCW 41.24.020(1); to provide for the collection and payment of fees as required by said chapter; and to do each and every act required to perfect the enrollment of all members of the town fire department under the relief and compensation provisions of said chapter. 2.36.030 Limitation on membership.

The membership of the town fire department is limited to not to exceed twenty-five (25) members and shall not be less than fifteen (15) members for the purpose of this chapter. No more than twenty-five (25) such members shall be eligible to participate in and receive the benefits herein provided. (Ord. 195 § 4, 1978; Ord. 193 § 2, 1978)

2.36.040 Administration.

Pursuant to the provisions of RCW 41.24.060, the administration of this chapter and the retirement benefits program herein authorized is vested in the board of trustees created by such section. (Ord. 195 § 5, 1978)

2.36.050 Participation of reserve police officers.

The town of Winthrop shall extend and allow its reserve police officers to participate in the Volunteer Fire Fighters’ and Reserve Officers Pension Act under Chapter 41.24 RCW. This coverage shall be in lieu of the Washington State Department of Labor and Industries Industrial Insurance, and shall pertain solely to the disability and death benefits under Chapter 41.24 RCW, and shall not pertain to the pension benefits covered under Chapter 41.24 RCW.
