9.12.010 Exemption from RCW 9.41.050(4).

The jurisdiction of the town is and shall be exempt from the prohibitions set forth in RCW 9.41.050(4) as presently enacted and as may be hereafter modified or recodified. This exemption is enacted pursuant to RCW 9.41.050(6). (Ord. 434 § 1, 1994)

9.12.020 Discharge of firearms and weapons.

A. Firearms. It is prohibited to aim or discharge any firearm, whether loaded or not, within the town of Winthrop.

B. Weapons. It is prohibited to aim, discharge, throw or launch any weapon or instrument, whether loaded or not, in any public place or in any place where there is a reasonable likelihood that humans, domestic animals or property will be jeopardized, within the town of Winthrop. This includes, but is not limited to, air guns, deadly missiles, slingshots, darts and arrows.

C. The following is an affirmative defense to this chapter, in compliance with RCW 9.41.300:

1. A person who is a law enforcement officer and acting in his official capacity.

2. A person who has a permit issued by the Winthrop town council regulating the use of firearms within the town.

3. A person who is engaged in the military activities sponsored by the federal or state government.

4. A person who is defending his/her life or the life of another.

D. Penalty. Any person or persons in violation of this section shall be guilty of a misdemeanor. (Ord. 545 §§ 1—3, 2002)
