15.04.010 Adopted.

Pursuant to Chapter 19.27 RCW, the town of Winthrop hereby adopts the following codes, as adopted and amended by the Washington State Code Council (Chapter 51-50 WAC) for the purpose of establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, including permits and penalties:

A. The 2018 International Building Code (IBC) published by the International Code Council. The following appendices are specifically adopted:

1. Appendix J, Grading.

B. The 2018 International Residential Building Code (IRC) published by the International Code Council. The following appendices are specifically adopted:

1. Appendix H, Patio Covers.

C. The 2018 International Mechanical Code (IMC) published by the International Code Council.

D. The 2018 International Fire Code (IFC), published by the International Code Council, Inc., including those standards of the National Fire Protection Association specifically referenced in the International Fire Code; provided, that notwithstanding any wording in this code, participants in religious ceremonies shall not be precluded from carrying hand-held candles. The following appendices are specifically adopted:

1. Appendix D, Fire Apparatus Access Roads.

E. The 2018 International Existing Building Code (IEBC) published by the International Code Council.

F. The 2018 International Plumbing Code (IPC) published by the International Code Council; provided, that any provisions of such code affecting sewers or fuel gas piping are not adopted.

G. Standard for Accessible and Usable Buildings and Facilities (ICC A117.1-2017) published by the International Code Council.

H. 2018 Washington State Energy Code – Residential Provisions published by the International Code Council.

I. 2018 Washington State Energy Code – Commercial Provisions published by the International Code Council.

J. In case of conflict among the codes enumerated in subsections A through E of this section, the first named code shall govern over those following. Whenever any conflict occurs between these codes and Chapter 15.08, Westernization, as amended, the life safety ramifications of codes in this section shall prevail over conflicting western theme requirements; however, it is incumbent on the building official to exercise judgment as allowed by the building codes to permit the use of materials and methods necessary to continue the popular western theme. 15.04.020 Consultant fees.

In addition to the building permit application and plan review fees an applicant must submit pursuant to the above codes herein adopted, whenever review of the building permit application requires the retention by the town of professional consultant services, the applicant shall reimburse the town for the cost of such professional consultant services. The town may also require the applicant to deposit an amount with the town estimated, in the discretion of the town, to be sufficient to cover anticipated costs of retaining professional consultant services and to ensure reimbursement to the town for such costs. 15.04.025 Waiver.

The town council may waive any fees or costs imposed under this chapter for buildings and structures that meet the following requirements: (A) such proposed building or structure must be constructed on town property, in which the town is the applicant, or upon town property in which another party is the applicant, but has previously entered into an agreement with the town in which such building or structure will be conveyed/transferred to the town upon completion of construction; (B) a description of the building or structure, together with substantiation that such building or structure is being constructed on town property and the town is the applicant, or is built on town property and an agreement has been entered into between the town and the applicant in which the building or structure shall be conveyed/transferred to the town upon completion of construction, must be submitted to the town council for consideration; and (C) if the town council grants a waiver as provided in this section, it shall be memorialized by resolution of the town council. 15.04.030 Violation—Penalty.

A. In addition to any remedies provided by any of the codes referred to in this chapter, failure to perform any act required, or the performance of any act prohibited by any of the codes referred to in this chapter, is designated to be a civil infraction, and any person, firm or corporation found to have committed such an infraction by failing to perform any act required by said codes, or performance of any act prohibited therein, shall be assessed a monetary penalty, which penalty may not exceed five hundred dollars ($500.00) for each offense.

B. Each day during which a violation continues shall be deemed a separate offense and penalties may be assessed for each separate offense.

C. Nothing contained herein shall prevent the town from taking such other lawful action as necessary to prevent or remedy any violation of codes referred to in this chapter. (Ord. 661 § 1 (part), 2013: Ord. 624 § 1 (part), 2010: Ord. 398 § 5, 1992. Formerly 15.04.040)
