B. The following provisions apply whenever payment for costs is indicated in the fee schedule. In addition, these provisions shall apply if the Town determines that, due to special circumstances, the fixed fee set forth in the fee schedule will not cover the costs of legal, engineering or other consultant services necessary to process the permit.
1. In addition to the base fee, the costs of legal, engineering or other consultants necessary to review and process land use or development applications shall be paid by the applicant. Those costs are determined by the Town’s contracts for services. A copy of the Town’s current rate schedule will be provided to permit applicants.
2. To ensure that the costs associated with land use or development applications are timely paid, the Town’s estimate of the required legal, engineering and other consultant costs that will be required to process each requested land use or development application shall be required to be deposited by the applicant with the Town at the time the application is submitted. The amounts deposited with the Town at the time the application is submitted are defined as the "original deposit." No interest shall accrue on the original deposit.
3. At any time that the costs associated with reviewing and processing land use or development applications exceed the applicant’s original deposit, the Town shall require that the applicant make additional contributions to the deposit in such amounts that the Town estimates shall be necessary to pay the legal, engineering and other consultant costs required to continue the review and processing of the land use or development application. No interest shall accrue on any additional deposits. No further work will be performed on land use or development applications until such additional deposits specified by the Town are paid by the applicant.
4. The applicant shall be billed directly for and shall be required to pay the costs associated with reviewing a land use or development application that exceeds the original deposit or any subsequent deposits, and shall be required to pay the same in full prior to the Town issuing any staff report, recommendation or decision on the land use or development application. If any bill sent to the applicant or other responsible party for the payment of legal, engineering or other consultant costs is not paid in full by the end of the billing month, interest shall accrue on the unpaid balance on the first day of the next month at the rate of twelve percent per annum.
5. In the event the amount deposited for the payment of legal, engineering and consultant costs associated with a land use or development application exceeds the actual costs for such services, the excess amount shall be refunded to the applicant after the processing of the application is complete.
6. Payment of the costs of legal, engineering or other consultants is required for all time spent reviewing the land use or development application, including all time spent through the completion of the Town’s review process by the Town’s final decision-maker, including any time associated with administrative appeals of the application.
7. In the event that a project or proposal is revised following issuance of a decision on a land use or development application, then the applicant is required to pay for the costs of legal revision.
C. Right-of-Way. The following are criteria for determining whenever a right-of-way permit is routine or major.
1. Routine Utility Projects. Many existing utilities conduct routine projects that have minimal impact to our ROW’s. A typical example would be the installation of a new water meter. Utility companies many times have their own internal engineering review.
2. Major Utility Projects. Examples include sewer extension applications. Activities that would involve significant disruption to ROW lands. Review by consulting engineers would be required.
3. Private Homeowners Projects. Construction projects conducted by home owners may require engineering approval depending on site specific conditions. Initial review will be made by the public works department. Projects that require significant alterations to the ROW will require engineering approval. All jobs will have to adhere to specifications previously established by the Engineer. 3.32.020 Payment and responsibility for fees.
A. All fees set forth in this chapter for construction permits governed by Title 12 are due and payable to the Town Clerk in accordance with Title 12.
B. The Town will not accept, process, review or examine any construction permit application, any land use or development application, conduct building permit final inspection approval or issue certificates of occupancy unless the corresponding fees set forth in this chapter have been paid in full to the Town. Following initial acceptance of the application, permit, or approval and fee for processing, failure to pay required fees within thirty days of the date of the Town invoice for such fees shall be grounds for cancellation of the application, permit or approval by the Town. The Town may issue a stop work order without advance notice when payment of required fees has not been received within thirty days of the date of the Town invoices for such fees.
C. Each application, review, permit or approval shall be charged as a separate fee.
D. Applicants for land use or development applications, permits or approvals, and the owners of the property for which an application, permit or approval is requested, are jointly and severally responsible for the payment of required fees, regardless of whether the application is approved, or the permit or approval is issued or has been canceled.
E. Payment of fees shall be in U.S. currency, in the form of cash, cashier’s check, or corporate or personal checks issued by instate banks. Further, the Town Clerk shall have full authority to refuse any form of payment where the Town Clerk believes sufficient cause exists to question the Town’s ability to collect full payment.
F. The total fee assessed for any application, permit or approval shall be paid in full.
G. Any unpaid fees, due and owing to the Town, but unpaid, shall be subject to such collection procedures as authorized by law. The applicant shall be responsible for both the unpaid fees, and the reasonable attorneys’ fees and costs incurred for collection of the unpaid fees.
H. In the event an applicant has not fully paid required fees, and the Town has suspended processing of the application, canceled the application, posted a stop-work order due to nonpayment of fees, or taken collection action, then any subsequent application, permit or approval filed by the same applicant may be accepted on a "cash only" basis at the discretion of the Mayor, who shall have full authority to make such determination.
