7.16.020 Construction.

The statutes set out in Section 7.16.010 of this chapter are incorporated by reference as though fully set forth, excepting only the penalty provisions thereof, which shall be exclusive of confinement in jail. The town reserves the right to refer the matter for prosecution by the state before a committing magistrate in the district court as an alternative to prosecution under the decriminalized town code, for violation of ordinances of the town with the concomitant potential expense and obligations to appoint counsel for indigent defendants. Any reference by Section 7.16.010 of this chapter to felonies or classification of felonies therein shall refer to the statutes of the state for definition and prosecution. (Ord. 100 § 5(part), 1979)
