10.08.010 Purpose.

This chapter is enacted in exercise of the police powers of Yakima County and the state of Washington for the protection and preservation of the health and safety of the public.

10.08.020 Permit – Required.

Permits are required and may be issued for either commercial or noncommercial road approaches to a county road.

The actual construction of any privately owned road approach is on the basis of a permit.

Permits may be granted for any location except on designated limited access roads, that will not conflict with the safety and free movement of road traffic. Construction and maintenance of these approaches is subject to the design and construction controls described later in these rules.

10.08.030 Permit – Application.

Application for a road approach permit must be made by application to the county engineer’s office. The applicant must be the owner, purchaser or lessee with consent of the owner of the property to be served by the road approach, or his authorized agent.

10.08.040 Inspections.

The Yakima County road department and its official agents and employees may not be held liable for personal injury or property damage sustained by reason of exercise of the permit.

No person, firm or corporation shall construct, modify or reconstruct any approach to a county road without first obtaining a properly executed permit from the county engineer. Under present law, the permittee is responsible for maintaining a11 road approaches between the shoulder on gravel roads and edge of pavement on paved roads and the right-of-way line. The county road department has the right to inspect all installations at the time of their construction and at any time afterwards and to require that necessary changes and repairs be made at the expense of the permittee.

10.08.050 Commercial Road Approaches – Generally.

To meet the various needs of the property owners desiring access to county roads two classes of road approaches are required: Commercial and Noncommercial.

(1)    Commercial Road Approaches. Commercial road approaches are those necessary to permit normal operation of a commercial establishment that is located on land abutting a county road.

The general design requirements for these road approaches are described as follows:

(a)    The location of road approaches must be consistent with the regulations in these rules and must not infringe on the frontage of adjoining property. Each road approach must be located so that it does not cause undue interference or hazard to the free movement of road traffic, as determined by the county engineer;

(b)    Horizontal, vertical alignment and width shall be as designated by the county engineer and so stated on the permit;

(c)    Surface drainage must be provided by the permittee unless otherwise stated in the permit. The drainage under fill areas and in roadway ditches must be large enough to carry the water that accumulates in the roadway ditches and in no case shall the size of the pipe be smaller than twelve inches in diameter culvert pipe and twenty-four feet in length;

(d)    The length of approach pipe placed in roadway ditches shall be limited to one hundred feet unless cleanouts are provided for at distances not to exceed one hundred feet.

Cleanouts shall consist of manhole type structures which will meet existing conditions, as approved by the county engineer.

10.08.060 Noncommercial Road Approaches – Generally.

Noncommercial road approaches are those necessary to permit normal travel from a residence or farm for their normal use, or some other special, noncommercial purpose approved by the county engineer.

(1)    The location of noncommercial road approaches must be so that they do not cause undue interference or hazard to the free movement of road traffic as determined by the county engineer and must not infringe on the frontage of adjoining property. When such approaches are installed, the existing road shoulder width must be preserved;

(2)    Horizontal and vertical alignment shall be as designated by the county engineer and so stated on the permit;

(3)    The minimum width of a driveway at the shoulder line of the road shall be twenty feet, maximum width shall be designated by the county engineer;

(4)    The drainage under fill areas and in roadway ditches must be large enough to carry the water accumulated in the roadway ditch and in no case shall the size of pipe be smaller than twelve inches in diameter culvert pipe;

(5)    The length of approach pipe placed in roadway ditches shall be limited to one hundred feet unless cleanouts are provided for at distances not to exceed one hundred feet.

Cleanouts shall consist of manhole type structures which will meet existing conditions, as approved by the county engineer.

10.08.070 Drainage provisions.

The permittee for both commercial and noncommercial road approaches must make provisions for handling the drainage from his own property, and no drainage that is caused by these installations of road approaches shall flow from commercial or private property onto the surface of the county road.

10.08.080 Construction requirements.

Construction requirements for all road approach permits shall be as follows:

(1)    All construction requirements of the permit must be completed within the time specified on the permit and in a manner that is satisfactory to the county engineer;

(2)    Approaches and related area must be constructed so that they do not impair drainage within the right-of-way, nor alter the stability of the roadway subgrade, nor materially alter the drainage of adjoining lands. Culverts, catch basins, ditches, etc. are to be constructed and maintained in accordance with the specifications and standards of the county engineer;

(3)    The county engineer has the right to specify the type, depth and area for surfacing and pavement for all road approaches;

(4)    All material needed to construct road approaches must be supplied by the permittee.

Materials must be satisfactory quality and in general conform to county road department specifications for that type of work. Construction materials are subject to approval by the county engineer.

10.08.090 Permit – Issuance.

All road approach permits must be issued by the county engineer at his office in the courthouse. Should the county engineer refuse to issue a road approach permit the applicant may reapply to the board of county commissioners and their decision shall be final.

10.08.100 Violation – Penalty.

Any person who shall violate any of the provisions of this chapter shall be guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed three hundred dollars or by imprisonment in the Yakima County jail not to exceed ninety days or by both such fine and imprisonment.
