2.60.010 Purpose.

The city council for the city of Zillah, Washington, has determined that it is in the best interests of all residents of the city of Zillah, as well as all employees of the city of Zillah, to establish an alcohol and drug abuse policy. This chapter is intended to establish a policy which will promote high standards of employee safety and health and public confidence in the city of Zillah. It is intended to increase employee awareness of the dangers of alcohol and/or drug abuse and to encourage any affected employee to seek appropriate assistance. In this regard, the city does hereby adopt the ordinance codified in this chapter establishing an alcohol and drug abuse policy in the manner and fashion set forth hereinbelow. (Ord. 697 § 1, 1991)

2.60.020 Application.

This chapter and policy shall apply to all applicants for employment and all current employees of the city of Zillah. This chapter and policy also applies to alcohol and all controlled substances, drugs or medications, legal or illegal, which could impair an employee’s ability to effectively and safely perform the job duties and functions assigned. 2.60.030 Employee responsibilities and duties.

Every employee of the city of Zillah shall abide by the following rules and restrictions:

A. No employee shall report to work while his or her ability to perform assigned job duties is impaired due to alcohol and/or drug use, occurring either during work hours or after work hours.

B. No employee shall possess or use alcohol and/or controlled substances (with or without a prescription) during working hours, except prescription drugs which have been reported to and approved by the employee’s supervisor. Each employee who receives a prescription for controlled substances shall notify his or her supervisor and shall provide the supervisor with any warnings or indicate any known side effects which may interfere with the safety and effective performance of such employee’s job duty.

C. No employee shall sell alcohol and/or controlled substances or provide alcohol and/or controlled substances to any other person or employee during working hours.

D. Each employee shall be required to notify his or her supervisor within five days of any criminal alcohol or drug related arrest or violation occurring during working hours. (Ord. 697 § 3, 1991)

2.60.040 Procedural rules.

The following rules of procedure shall apply concerning the effective administration of this chapter and policy:

A. No employee shall be permitted to work or continue to work while in possession of or under the influence of alcohol or a controlled substance which in any way effects the safe and efficient physical performance or which inhibits mental judgment during work hours. Any employee found to be in possession of or under the influence of alcohol or controlled substances will be removed from the work site and will be subject to disciplinary actions.

B. Employees required to use prescribed controlled substances shall be permitted to report to work and continue to work so long as the prescribed drug does not affect the safety and the efficient physical and mental performance of the employee.

C. Any employee found to be manufacturing or selling alcohol and/or controlled substances to any other person on city property or during work hours shall be subject to disciplinary action.

D. Any incident involving a city employee’s violation of the alcohol and drug abuse policy shall be discussed with the employee and will be documented in writing. The employment manual of the city of Zillah shall control and be applicable as to procedures for disciplinary actions including and up to any employee’s discharge.

E. The city shall provide information, educational materials and training to all employees with regard to the dangers of alcohol and/or drug abuse. In addition, the city will assist any employee diagnosed or determined to have an alcohol and/or drug abuse problem with obtaining assistance and treatment of the condition through appropriate treatment centers and agencies.

F. The city clerk/treasurer shall be required to notify any federal agency from which the city is a recipient of federal grant funds of any criminal conviction of a city employee within 10 days after receiving notice that the employee was convicted of a criminal drug or alcohol violation under state, federal or local law. 2.60.050 Severability.

If any provision of this chapter or its application to any person or circumstance is held to be invalid, the remainder of this chapter or the application of the provisions to other persons or circumstances shall not be affected. (Ord. 697 § 5, 1991)
