10.85.010 Parking prohibited – Generally.

A. The city council may, from time to time, establish parking restrictions on portions of designated public streets and rights-of-way. City administrator shall maintain a record of adopted parking restrictions and amendments, additions, deletions, or exceptions as adopted by city council. Such records shall be maintained by city administrator at City Hall.

B. In addition, copies of adopted restrictions shall be available for examination by the public during regular business hours. (Ord. 1485 § 1, 2019; Ord. 1438 § 4, 2017)

10.85.015 Parking prohibited – Specific streets.

In addition to parking that is otherwise prohibited, parking on the following city streets or rights-of-way is prohibited at the following locations:

A. Both sides of First Avenue from 5th Street to the western city limits at Interstate 82.

B. Both sides of Cheyne Road from First Avenue to the northern city limits at Yakima Valley Highway.

C. The west side of 5th Street from Second Avenue to the Carlsonia Avenue.

D. The east side of 5th Street from First Avenue to Glenwood Drive.

E. The east side of 5th Street from Schooley Road to the city limits at Cutler Way.

F. The west side of Donald Street.

G. Both sides of Carlsonia Avenue.

H. North side of Cutler Way from Cheyne Road to the western city limits.

I. Both sides of Nob Hill between Maple Way and Glen Drive.

J. The north side of Maple Way between Glen Drive and Concord Street.

K. The eastern edge of Dean Street from Carlsonia Avenue to Fourth Avenue during the school year. (Ord. 1485 § 1, 2019)

10.85.020 Weight and load parking regulation.

A. Trucks, trailers or any combination of truck/trailer and truck tractors, whether connected or not and/or 30,000 pounds gross vehicle licensed, loaded or unloaded, are prohibited from parking on city streets, except as permitted below:

1. Parking is permitted on First Avenue for up to one hour.

2. Parking is permitted on Second Avenue between Fifth Street and Eighth Street for up to one hour.

3. Parking is permitted on Sixth Street, Seventh Street and Eighth Street between First Avenue and Second Avenue for up to one hour.

4. Parking is permitted on Vintage Valley Parkway for up to one hour.

5. Parking is permitted on Zillah West Road for up to one hour. (Ord. 1485 § 1, 2019)

10.85.025 Regulating on-street parking.

A. No person, firm, company or entity shall park any motor vehicle on (1) First Avenue or Second Avenue between Fifth Street and Eighth Street, and (2) on Fifth, Sixth, Seventh, and Eighth Streets between First Avenue and Second Avenue on Fridays between the hours of 4:00 a.m. to 7:00 a.m.

B. No person, firm, company or entity shall park any motor vehicle on the east side of Dean Street from 2:15 p.m. to 3:15 p.m. during the school year.

C. Any person who shall park a car on the public streets or rights-of-way in violation of adopted restrictions shall be guilty of a civil infraction and, upon conviction thereof, shall be fined in the amount of $20.00 for the first violation and $50.00 for each subsequent violation.

D. The assessment and collection of fines for violation of this chapter shall be subject to procedures for collection of traffic infractions by the municipal court. (Ord. 1485 § 1, 2019; Ord. 1438 § 4, 2017. Formerly 10.85.020)

10.85.030 Temporary parking prohibited, street cleaning, snow removal, road construction and special events.

A. The director of public works, chief of police or fire chief may determine that special temporary parking restrictions are necessary for any public safety reason or for the purpose of street cleaning, snow removal, roadway construction or special events. It is a civil infraction for any person to violate the provisions of a temporary parking restriction.

B. Public Notice Requirement. When any temporary parking regulation is placed on a roadway or public right-of-way by the director of public works, chief of police or fire chief, the official shall cause temporary signs or notices to be posted in and/or near the affected area. The notices shall be conspicuously designed and placed to provide adequate notice to the public of the restrictions.

C. No vehicle will be impounded under this section unless the notices have been in place for a minimum of 24 hours and the notice states that vehicles may be impounded. (Ord. 1485 § 1, 2019)

10.85.040 Parking over 72 hours prohibited.

Parking a motor vehicle on any city street or right-of-way for 72 hours or more is prohibited. (Ord. 1485 § 1, 2019)

10.85.050 Exemptions.

Authorized emergency vehicles are exempt from the provisions contained in this chapter. (Ord. 1485 § 1, 2019)

10.85.060 Fire lanes.

A. Parking in a designated fire lane is prohibited.

B. Any person who shall park a motorized vehicle in violation of this section shall be guilty of a civil infraction and, upon conviction thereof, may be fined in the amount of $150.00.

C. Vehicles parked in marked fire lanes are declared a nuisance and may be removed or impounded as provided by law in addition to any civil penalties imposed. (Ord. 1485 § 1, 2019)

10.85.070 Impoundment of vehicle.

A. It is unlawful to park or leave any vehicle in a manner that violates provisions of the adopted Model Traffic Ordinance (Chapter 10.04 ZMC) or otherwise obstructs or impedes the use and safety of operation of public streets. Any vehicle angle-parked so as to obstruct, impede or impair safety or function of any street or right-of-way is declared to be a nuisance which may be summarily abated by the impounding and removal of the vehicle as herein provided.

B. Any vehicle which is stolen or which is required by the police department for evidence of investigation, which is unoccupied or unattended and, in the judgment of any police officer, in danger of being stripped or stolen, or any wrecked and unattended vehicle may be impounded and removed as hereinafter provided. 10.85.080 Obstruction of mail delivery receptacle.

A. No person shall park a vehicle or otherwise cause an obstruction to be placed in the public streets or rights-of-way which interferes with or otherwise impedes access to a United States mail receptacle by employees of the United States Postal Service except such prohibition shall not be applicable in times of extreme snow or weather conditions or other similar emergency or extraordinary circumstances.

B. A violation of this section shall be subject to a civil infraction as follows:

1. Upon finding of guilt, said person may be fined in an amount of up to $50.00 per violation.

2. Each day the obstruction remains in front of a mail receptacle shall constitute a separate violation. (Ord. 1485 § 1, 2019; Ord. 1438 § 4, 2017. Formerly 10.85.040)

10.85.090 Moving vehicle of another – Authorized under special condition.

A. Any vehicle otherwise legally parked but obstructing access to a public facility including utilities, poles, manholes, etc., or restricting movement of an oversized vehicular load may be moved under emergency conditions at the direction of a law enforcement officer by means of towing or otherwise to a location not to exceed 300 feet away from such interference.

B. The law enforcement officer authorizing such parked vehicle to be moved shall affix notice in writing to the vehicle on which shall be noted the location from which the vehicle has been moved, the location to which the vehicle has been moved and the reason for the removal.

C. Any charge for towing shall be at the expense and liability of the vehicle owner.
