11.01.010 Adoption by reference.
The “Washington Model Traffic Ordinance,” Chapter 46.90 RCW, hereinafter referred to as the “MTO,” and RCW 46.52.088, 46.61.072, 46.61.202, 46.61.215, 46.61.261, 46.61.264, 46.61.266, 46.61.269, 46.61.520, 46.61.540, 46.61.606, 46.61.608, 46.61.614, and 46.65.017 are hereby adopted by reference as and for the traffic ordinance of this County as if set forth in full herein.
11.01.020 Disposition of traffic fines and forfeitures.
All fines and forfeitures collected for violation of any of the provisions of the ordinance codified in this chapter shall be deposited in the current expense fund of Clallam County, after a prorated share of the expense of the administration of the district court has been deducted.
11.01.030 Official misconduct.
Failure, refusal, or neglect on the part of any judicial or other officer or employee receiving or having custody of any such fine or forfeiture of bail, either before or after a deposit in said general fund, to comply with the provisions of CCC 11.01.020 shall constitute misconduct in office and shall be grounds for removal therefrom, provided appropriate removal action is taken pursuant to State law relating to removal of public officials.
11.01.040 Filing of ordinance.
Incident to the adoption of the MTO by reference, by this chapter, copies of the text of the adopted MTO and of other adopted statutes shall be filed as required under the Revised Code of Washington for use and examination by the public.
11.01.050 Severability.
If any section, subsection, paragraph, sentence, clause or phrase of this chapter is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this chapter; it being hereby expressly declared that this chapter and each section, subsection, paragraph, sentence, clause and phrase thereof would have been adopted irrespective of the fact that any one or more other sections, subsections, paragraphs, sentences, clauses, or phrases be declared invalid or unconstitutional.
11.01.060 Repealer.
Ordinance No. 35-1971 and all ordinances or parts of ordinances in conflict herewith are hereby repealed.

11.04.010 Authority – Speed limit 35 mph.
Pursuant to RCW 46.61.415, providing for local determination and declaration of reasonable and safe maximum speed limits, the speed limit on all County roads in Clallam County shall be 35 miles per hour unless otherwise provided herein, or unless a lower speed limit is specifically provided by statute, County ordinance, or other law.
On those portions of County roads that become annexed, vacated, or abandoned, this chapter will be considered null and void.
11.04.020 Speed limit 20 mph.
The following County roads shall have a speed limit of 20 miles per hour:
(1) All County roads within Clallam County park and recreation areas; and
(2) The following roads:

(3) Five hundred feet in advance of all school areas located adjacent to County roads “when children are present.”
11.04.030 Speed limit 25 mph.
The following County roads shall have a speed limit of 25 miles per hour:
(1) All County roads in all subdivisions, planned unit developments, mobile home or mobile home parks or campground plats; and such plats shall provide for the proper posting of such speed limit pursuant to CCC 11.04.080; except as otherwise noted in this chapter.
(2) All County roads within the Transportation Improvement Board boundary described as: West boundary, commencing at the mouth of Dry Creek on the Strait of Juan de Fuca, in Section 36, Township 31 North, Range 7 West, W.M.; thence southwesterly along meander of Dry Creek to the intersection of an abandoned railroad grade (Chicago-Milwaukee-St. Paul and Pacific); thence westerly approximately 530 feet to intersection with Lower Elwha Road (M.P. 0.77); thence south on Lower Elwha Road to intersection with West Edgewood Drive; thence east on West Edgewood Drive to the intersection of Dry Creek Road; thence south on Dry Creek Road to intersection with State Highway U.S. 101; thence east on State Highway U.S. 101 to intersection with the Benson Road; thence south on Benson Road to milepost 0.72, and on a straight line south to the B.P.A. transmission line; thence southeasterly along B.P.A. transmission line to the Port Angeles city limits; thence following the boundary of Port Angeles south city limits to South Golf Course Road and the B.P.A. transmission line; thence southeasterly along the B.P.A. transmission line to intersect with Morse Creek; thence northerly along meander of Morse Creek to State Highway U.S. 101; thence northeasterly following State Highway U.S. 101 to the intersection with Buchanan Drive; thence northerly on Buchanan Drive and continuing in a straight line to the Strait of Juan de Fuca, and the end of this boundary description.
All County roads in this described area shall have a speed limit of 25 miles per hour, except the following roads: Edgewood Drive, Lower Elwha Road, Black Diamond Road, Monroe Road, and Mount Pleasant Road.
(3) All County roads within the Townsite of Clallam Bay, Washington.
(4) All County roads within the Townsite of Sekiu, Washington.
(5) All Clallam County roads within Sections 26, 34, 35, Township 30 North, Range 13 West, W.M. (Lake Pleasant region).
(6) All Clallam County roads subject to bituminous surface treatment within the last 48 hours.

11.04.080 Posting of speed limits.
The posting of speed limits described in CCC 11.04.010 through 11.04.070 shall conform with Part 2, Signs, of the Manual on Uniform Traffic Control Devices for Streets and Highways, as enacted and adopted, or as may be hereafter amended.
11.04.090 Penalty.
Any violation of this chapter shall constitute a misdemeanor and shall be subject to penalty as provided under RCW 46.61.010.
11.04.100 Severability.
If any section, subsection, paragraph, sentence, clause or phrase of this chapter is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portion of this chapter; it being expressly declared that this chapter, and each section, paragraph, sentence, clause and phrase thereof would have been adopted irrespective of the fact that any one or more other sections, clauses, or phrases be declared invalid or unconstitutional.
11.04.110 Effective date.
This chapter shall take effect 10 days after adoption.

11.08.010 General provision.
The County of Clallam, State of Washington, pursuant to written agreements between the City of Port Angeles, State of Washington, shall hereafter operate a traffic school in accordance with the Laws of the State of Washington, 1959, Chapter 182.
11.08.020 Purpose.
The purpose of the traffic school shall be to instruct, educate, and inform all persons appearing for training in the proper, lawful and safe operation of motor vehicles.
11.08.030 Attendance required – Violation.
Every person required to attend the traffic school shall maintain attendance in accordance with the orders or sentence of the court. Failure to do so, unless for good cause shown by clear and convincing attendance, shall be a misdemeanor and punishable as by law provided in addition to the imposition of any punishment suspended or deferred upon the original conviction.
11.08.040 Effective date.
This chapter shall be in full force and effect five days from and after the date of its passage.

11.11.010 Findings.
The Board of Clallam County Commissioners finds that there are several areas of the County where engine compression brakes are used regularly and that the use of such brakes is not in the best interest of the public health and general welfare of the citizens present in those areas.
The Board further finds that neither the terrain nor road design geometrics, in these areas, warrant the regular use of engine compression brakes.
The Board further finds that high volumes of vehicles equipped with engine compression brakes travel through those areas described in CCC 11.11.040 and that such volume, coupled with regular use of such brakes, has created an intolerable environment for persons present in those areas.
11.11.015 Definitions.
For the purposes of this chapter, the following words and phrases shall be defined as follows:
(1) “Brake” means any device used for slowing, halting, or stopping the movement of any vehicle.
(2) “Engine compression brake” means any motor vehicle brake that is operated by the compression of the engine of the motor vehicle or any unit or part thereof. An engine compression brake is also referred to as a “jake brake.”
(3) “Motor vehicle” means and includes automobiles, tractors, trucks, trailers, and transportation equipment of all kinds and sizes, or any combinations of the foregoing.
(4) “Muffled” means fitted with a device that absorbs noise and, therefore, reduces the sound made by the engine compression brake.
11.11.020 Use of unmuffled compression brakes prohibited.
No person shall use motor vehicle brakes which are in any way activated or operated by the compression of the engine of such motor vehicle or any unit or part thereof, unless such braking system is equipped with a functional muffler. Such prohibition shall not apply if an emergency situation exists, and the use of unmuffled engine compression brakes is necessary for the protection or persons or property.
11.11.030 Use of compression brakes prohibited in certain areas.
No person shall use motor vehicle brakes which are in any way activated or operated by the compression of the engine of such motor vehicle or any unit or part thereof; provided, that such prohibition shall be applicable only to those public highways or portions thereof identified in CCC 11.11.040; provided further, that such prohibition shall not apply if an emergency situation exists and the use of engine compression brakes is necessary for the protection of persons or property.
11.11.040 Areas of prohibition.
The prohibition set forth in CCC 11.11.030 shall apply to the following public highways or portions thereof:
(1) State Route 112 between milepost 16.40 (Clallam Cannery) and milepost 16.97 (Weel Road), inclusive.
(2) State Route 112 between milepost 50.36 (“Entering Joyce” sign) and milepost 51.49 (“Leaving Joyce” sign), inclusive.
(3) Diamond Point Road #58250 between milepost 0.00 (State Route 101) and milepost 0.75 (0.75 miles north of State Route 101), inclusive.
(4) Evans Road #51650 between milepost 0.80 (0.80 miles north of Old Olympic Highway) and milepost 0.96 (0.96 miles north of Old Olympic Highway) inclusive.
(5) Maxfield Road #15030 between milepost 0.00 (State Route 101) and milepost 0.34 (east side of Shuwah Bridge), inclusive.
(6) Olympic Hot Springs Road #30380 between milepost 1.88 (1.88 miles south of State Route 101) and milepost 1.96 (Olympic National Park Boundary), inclusive.

11.11.050 Penalty.
(1) Any person violating the provisions of this chapter shall have committed a traffic infraction and a penalty of $100 shall be imposed.
(2) Penalties shall become due and payable thirty (30) days from the date of receipt of the notice of traffic infraction.
(3) Violations shall be enforced by such authorities and in such manner as set forth in Chapter 46.63 RCW.
11.11.060 Posting.
The Clallam County Road Engineer, or his or its successor, is authorized and directed to post appropriate signs consistent with the provisions of this chapter.
11.11.070 Effective date.
This chapter shall take effect ten (10) days after adoption.

11.12.000 Purpose.
Whereas, unrestricted use of the Clallam County Courthouse parking lot is now becoming a hindrance to the proper functioning of County government inasmuch as County officials are not assured of parking in the close proximity to the Courthouse that their duties require; and
Whereas, this hindrance to the proper functioning of County government is posing a threat to the health, safety and welfare of all the citizens of Clallam County; and
Whereas, the County Commissioners are charged with the care of the County property and the power to make and enforce regulations to protect the health, safety and welfare of the citizens.
11.12.010 Prohibited parking.
Parking of vehicles is prohibited, except as authorized in CCC 11.12.020, within the following described parking lot:
That parking lot located immediately east of the Clallam County Courthouse building in the City of Port Angeles and bounded on the south by East 4th Street, on the north by East 3rd Street extended, and on the east by the Roosevelt Junior High School track.
11.12.020 Authorized parking spaces.

The above number of parking spaces shall be posted for use by the above persons or deputies. When on County business, any such person or deputy is authorized to use any parking space so posted for their use.
Two (2) parking spaces shall be posted as “No Parking – Loading Zone Only” and one parking space as “No Parking Except for Gas.” These parking spaces are authorized for use as posted by those persons on County business.
11.12.030 Removal of vehicles authorized.
Whenever the Sheriff of Clallam County finds a vehicle parked in violation of this chapter, he is authorized to have such vehicle removed from such property and stored or held for its owner. The Sheriff may appoint any tow truck operator engaged in removing and storing motor vehicles within Clallam County to remove and store vehicles parking in violation of this chapter. Such tow truck operator shall be subject to the provisions of RCW 46.52.119.
11.12.040 Fines authorized.
Any person parking a vehicle in violation of this chapter shall be deemed guilty of a misdemeanor and shall be subject on conviction to a fine of not more than $50 for each violation. Prosecution of any such violation shall be at the discretion of the Clallam County Prosecuting Attorney or any County law enforcement officer.
11.12.050 Severability.
If any provision of this chapter on its face, or its application to any person or circumstances is held invalid, the remainder of this chapter, or the application of the provision to other persons or circumstances is not affected.
11.12.060 Signing.
A sign shall be placed at the entrance to subject parking lot stating that parking is prohibited except as posted and that illegally parked cars are subject to removal and their owners subject to fine.
11.12.070 Effective date.
This chapter shall take effect midnight July 1, 1975.

11.13.010 Purpose.
The Board of County Commissioners finds that it is necessary for the protection and welfare of the general public to prohibit parking in certain areas designated by the County Road Engineer and that the removal and storage of illegally parked vehicles at the owner’s expense be authorized.
11.13.020 Authority.
RCW 46.61.570.1(c)(ii) prohibits parking at any place where official signs prohibit parking. Chapter 46.63 RCW et seq. designates parking violations as traffic infractions, and provides for procedures and penalties relating to such violations.
11.13.030 Signs posted.
At locations as determined by the County Road Engineer, certain County rights-of-way shall be posted with signs identifying the location where parking prohibitions apply and the times during which parking prohibitions apply.
11.13.040 Notice of infraction/removal of vehicles authorized.
Whenever the Sheriff of Clallam County (or his deputies) finds a vehicle parked in violation of this chapter, he shall comply with the notification procedure set forth in RCW 46.63.030 and/or RCW 46.55.085 as now or hereafter amended; provided, that whenever an unattended vehicle is found parked in violation of this chapter and the vehicle constitutes an obstruction to traffic or jeopardizes public safety, the Sheriff or his deputies may provide for its prompt removal to a place of safety; provided further, that a place of safety includes the business location of a registered tow truck operator.
11.13.050 Fines authorized.
Any person parking a vehicle in violation of this chapter shall be deemed guilty of a traffic infraction and shall be subject on conviction to a fine of not more than $50 for each violation.
11.13.060 Severability.

11.13A.010 Purpose.
RCW 46.08.065 provides for the conspicuous marking of publicly owned vehicles used on public highways with insignia on right and left sides of the vehicles. An exception may be granted by the governing body to allow for marking plainly and conspicuously in the lower left-hand corner of the rear window with the name of the agency, the County insignia and the words “Clallam County – For Official Use Only.” This type of marking is desired for some of the Clallam County fleet.
11.13A.020 Alternative vehicle marking authorized.
All County-owned public vehicles operated on public highways shall be marked in accordance with all provisions, alternatively, of RCW 46.08.065 as now or hereafter amended.
11.13A.030 Effective date.
This chapter shall take effect ten (10) days from adoption of this ordinance.
