9.32.010 Discharging firearm within city limits unlawful.

A. It is unlawful for any person within the city limits of the city to discharge a firearm and/or otherwise shoot or cast a projectile by means of any blowgun, air gun, rifle, pistol, slingshot, bow, or any other device capable of causing physical injury or property damage; provided, that this prohibition does not apply to the discharge of firearms by law enforcement officers engaged in the performance of their official powers or duties.

B. Any person found guilty of this offense shall be deemed guilty of a misdemeanor.

C. The city council or a committee thereof designated by the city council may, upon written application filed with the city clerk, grant a variance from any of the provisions of this section.

Upon the granting of a variance, the mayor shall issue a special permit to the applicant to conduct the activity for which a variance has been granted.

Any variance granted and any special permit issued thereunder shall state the nature of the activity, and the date, times and place for which the variance is granted, and shall state any special provisions or limitations applicable to the exercise of the variance.

Any activity conducted under a variance and special permit shall conform strictly to the terms and provisions of the variance and special permit. (Ord. 1445 NS § 1, 2010; Ord. 1382 NS, 2007; Ord. 1105 NS § 2, 1995; Ord. 833 NS §§ 1, 2, 1981).

9.32.030 Storage of dynamite or gunpowder prohibited.

Any person or persons, firm or corporation who keeps within the corporate limits of the city, or within 100 yards thereof, more than 25 pounds of dynamite, blasting powder, giant powder or gunpowder or who keeps the 25 pounds in any manner than in some receptacle of iron or covered with iron so that in case of fire it can be conveniently removed, shall be deemed guilty of a misdemeanor, and, upon conviction thereof, punished by a fine of not more than $100.00 and costs of prosecution or by confinement in the city jail for a period not exceeding 30 days. 9.32.040 Exemption from state restrictions on carrying firearms.
