13.24.010 Additional connection charge.

In addition to the charges for installing the connection and meter, an owner of property fronting on a main for which the property has neither been assessed nor otherwise paid its pro rata share of the cost of the main shall be required to pay the pro-rata share to the City as a condition to the right to connect to the main. The charges may be collected either for the benefit of the City Water System or for private persons who have paid the cost of constructing the main and have entered into a recovery contract with the City. 13.24.020 Recovery contract – Collection of front footage cost.

13.24.030 Collection – Enforcement.

13.24.040 Collection – Waiver.

Where mains have been constructed by or for the City without assessment of abutting property and where a water main extension is proposed to serve abutting property, the City may waive collection of all or part of connecting charges due the City. Such waiver shall be for the purpose of encouraging extensions of the distribution system and may be granted only under the following circumstances:

A. Waiver shall be granted in any case where a previous recovery contract would prohibit inclusion of the particular frontage in a second recovery contract.

B. The total length of the proposed extension shall be at least 300 feet or equal to the frontage of the property, on the City’s main, for which waiver is requested, whichever is the greater.

C. Frontage for which waiver is granted shall include the width of newly platted rights-of-way.

D. Wherever the tract being subdivided has a corner with frontage on City mains on 2 sides, waiver shall be granted for 100 feet adjacent to such corner unless the tract being subdivided has a lesser dimension in either direction from the corner, which lesser dimension shall prevail.

E. In order that lots in any new subdivision shall either all be served with water without payment of connection charges or all be subject to payment of connection charges, developers who install water system extensions to serve a new subdivision shall pay the full connection charge for all land platted adjacent to City mains (less amount waived) as a condition to the providing of water service to the extension. (Ord. 1091 § 5.01(C), 1971).

13.24.050 Connection charge to City-owned mains.

A. All connection charges for service from water and sewer mains owned by the City installed after January 1, 1972, and not subject to recovery contracts shall be based on the actual construction cost apportioned according to front footage or any other equitable method of apportionment. These charges are declared to represent a fair pro rata share of the cost of construction of a main with appurtenances, without regard to the actual size of mains constructed.

B. Where the City has participated in a project financed by the method of “Cash Contributions,” the connection charge shall be the fair share of the actual construction costs. The connection charges shall not apply to premises which:

1. Have been previously connected without payment of connection charges;

2. Are served by mains constructed for the purpose of serving the premises and donated to the City; or

3. Are situated on property for which connection charges have been previously paid. (Ord. 1901 § 1, 1991; Ord. 1091 § 5.01(D), 1971).

13.24.060 Connection charge for partial water line extensions.

Under special circumstances, such as at pressure zone separations, the City may permit only a portion of a water extension to be constructed. In such cases, the developer shall deposit a sum of money calculated at a rate established under IMC 13.24.050 for the portion of frontage not covered by the extension but required to be covered under IMC 13.12.010 and 13.16.030. The sum shall be used by the City to pay the developer’s portion of a future extension past the frontage not covered by the partial extension. No refund shall be made if the owner’s fair share of the cost is less than the payment to the City; neither shall the City claim any additional amount due if it incurs a greater cost for construction. 13.24.070 Hydrant charges.

A. Fire Districts. Any fire district having fire hydrants served by the City Water System shall pay the City the sum of $5.00 per annum for each fire hydrant served. The charge is to cover the City’s annual cost of maintaining the hydrants and valves and providing water adequate for fire protection. It is understood that no fire district shall begin paying the sum until such time as the fire district has the service of a fire truck. It also understood that fire district crews shall use discretion in the use of water and the handling of fire hydrants during fire drills. A district will be notified no later than July 31st of the current year as to the number of hydrants within the district for which the $5.00 fee will be charged for the following year.

B. Private Fire Protection, Automatic Sprinkler System, Wet or Dry Standpipes. The rates for water supplied for fire protection of standby service, exclusively, shall be deemed service charges and shall be, for any 1 month or fractional part thereof, equal to the minimum monthly residential charge. (Ord. 1091 § 5.02, 1971).

13.24.080 Service installation fees.

A. No service installation fee shall be levied against any building in which there is an existing water service, including meter and meter box, which was installed by a developer or other agency and meets the requirements of this Code as to location and materials used.

B. Fees for installation of water meters shall be listed in the current Public Works Department Schedule of Charges. These fees shall be paid in cash prior to connection to a City water main and shall include the cost of connection, water meter, meter box, fittings, and shut-off valves. Pressure-reducing devices and check valves shall not be included, but shall be installed, when required, by the customer in his system within the property served. Fixed fees shall include up to 60 feet of service line, beyond which the cost of materials and labor shall be separately billed. (Ord. 1391 § 1, 1979; Ord. 1262 § 1, 1977; Ord. 1091 § 5.03, 1971).

13.24.090 General facility charge – Water.

A. Beginning August 19, 1996, and thereafter in addition to other fees imposed by ordinance or pursuant to agreements, there is imposed upon the owners of property seeking to provide water service to their property by connecting to the City’s water system, a general facility charge. The charge shall be in accordance with the schedule of charges contained in this section entitled “Water General Facility Charge”; provided, however, that when the City requires a fire suppression system (fire sprinkler) in a single-family residence, the City shall not charge that residence a general facility charge rate greater than that established for a meter sized for the same residence but without a fire suppression system, as set forth in this section.

B. The general facility charge for all new connections to Issaquah’s water utility shall be paid in accordance with the table below, titled “Water General Facility Charge.” The water general facility charge becomes effective January 1, 2009.

C. Applicants for water connection shall pay the applicable general facility charge in effect at the time the construction permit authorizing the connection to the water system is issued. 13.24.110 Water rates – Generally.

The consumption and use of all water taken from the City Water System, or from the water system of any water district or association which obtains its water from the City Water System, shall be metered at every connection to the water system. Rates or charges for water use shall be based on the quantity consumed during each billing period as hereinafter defined. The fixed charge for any billing period shall not be less than the amounts set forth in the table of fixed charges based on meter size.

A. Billing Period. The normal billing period shall be 2 months, which for accounting purposes shall be on the first day of the month during which the meters are read. Charges for periods of less than 2 months shall be prorated both as to fixed charge and as to consumption. All meters installed on the system shall pay the fixed bi-monthly charge whether turned on or off.

B. Billing Increments. Charges for water used shall be computed on the nearest 100 cubic feet of consumption.

C. Rates. All water used for domestic and commercial purposes shall be supplied by meter only. The rates for metered water supplied to premises shall be per account (meter) and shall be in accordance with the schedule of charges contained in this section, entitled “Water Rates.” These water rates will become effective the first full billing cycle after November 1, 2008.

D. Billing Procedure. All bills shall be sent to the owners of record except when the tenant appears at the City Hall and signs a notarized statement accepting responsibility for payment.

E. All irrigation meters shall be classified and billed as single-family residential accounts. 13.24.120 Water rates – Delinquent.

All water rates will be charged against the premises for which the service was installed. All charges for water, when the same become delinquent and unpaid, shall be a lien against the premises to which water has been furnished. (Ord. 1091 § 6.05, 1971).

13.24.130 Accounts – Billing and delinquency.

A. It shall be the duty of the Finance Director to keep accounts with all consumers of water, and to enter on such accounts all charges and penalties. The Finance Director shall cause to be kept proper accounts with all consumers of water, and, every 60 days or less, compile a statement of the names and property of such consumers as are delinquent, and shall forthwith cause that service of these consumers to be discontinued.

B. An account shall be deemed delinquent if not paid within 30 days of the due date. Delinquent accounts shall be subject to a 10 percent service charge. There shall be a further 10 percent service charge for each additional 2 months of delinquency. Water connections shall be cut off 30 days after an account becomes delinquent.
