17.77.010 Purpose.
The purpose of the transit overlay is to provide coordinated land use, parking and transportation services that support the development of a pedestrian-oriented downtown center and a multi-modal hub that incorporates bus, train and paratransit service, as well as parking, bicycle and pedestrian facilities. Development within the transit overlay is intended to be coordinated with a new train station in the east end of downtown as a regional commuter rail system is developed along the existing rail right-of-way. 17.77.020 Applicability.
This overlay zone applies to properties designated as appropriate in the city’s Comprehensive Plan and noted on the city’s zoning map. The regulations in this chapter apply only to development located within the transit overlay and meeting the purpose and intent of SMC 17.77.010. All other development within the area shall conform to the regulations of the underlying zoning district. (Ord. 1164 § 4, 2004).
17.77.030 Interpretation.
In the case of a conflict between the regulations of this overlay zone and those of the underlying zone, the regulations of this overlay shall control for transit-oriented structures meeting the intent of SMC 17.77.010; the underlying zone shall control for all other structures. (Ord. 1164 § 4, 2004).
17.77.040 Definitions.
“Transit-oriented development” means pedestrian-friendly development focused around a major transit access point. Elements include compact, mixed-use development with facilities and design that enhance the environment for pedestrians in terms of safety, walking distances, comfort and the visual appeal of the surroundings. (Ord. 1164 § 4, 2004).
17.77.050 Site plan criteria.
(1) Site Plan Criteria.
(a) Pedestrian connections shall be provided between all parking stalls and surrounding buildings.
(b) Building Orientation. All buildings shall be oriented to provide pedestrian entries along public streets and from the parking lot. (Ord. 1249 § 2, 2009; Ord. 1164 § 4, 2004).
17.77.060 Permitted uses.
The following uses shall be permitted in this zone:
(1) Residential. Buildings occupied or intended to be occupied for residential purposes and supporting activities, including:
(a) Attached dwellings (townhouses);
(b) Multifamily dwellings;
(c) Mixed use (residential over commercial);
(d) Home occupations;
(e) Group homes;
(f) Family daycare homes;
(g) Accessory buildings/structures (including accessory dwelling units).
(2) Bed and Breakfast Accommodations. Any building used or intended to be used, rented, or hired out to be occupied for sleeping purposes by guests.
(a) Bed and breakfast residences;
(b) Bed and breakfast inns;
(c) Accessory buildings/structures.
(3) Retail Trade Establishments. Establishments primarily engaged in providing finished products to individuals. However, no car dealerships, gasoline stations, auto repair facilities, drive-through restaurants, or car washes are to be allowed in this zone.
(a) Antique shops;
(b) Apparel and accessories shops;
(c) Banks;
(d) Book and stationery stores;
(e) Boutiques;
(f) Cafes;
(g) Camera/photographic equipment stores;
(h) Confectionery shops/bakeries;
(i) Dry cleaners;
(j) Espresso stands;
(k) Florists;
(l) Magazine stands;
(m) Neighborhood grocery stores;
(n) Newsstands;
(o) Pharmacies;
(p) Retail food establishments (no drive-throughs permitted except espresso stands);
(q) Video rentals and sales stores;
(r) Accessory buildings/structures.
(4) Personal Services. Establishments primarily engaged in providing services to individuals.
(a) Banks;
(b) Barber shops;
(c) Beauty shops/spas;
(d) Shoe repair services;
(e) Opticians;
(f) Laundromats/dry cleaners;
(g) Daycare centers or mini daycare facilities;
(h) Accessory buildings/structures.
(5) Business or Professional Services. Establishments primarily engaged in rendering services to other businesses or private individuals on a fee or contract basis.
(a) Legal services;
(b) Finance, insurance, and real estate services;
(c) Travel services;
(d) Professional consultants;
(e) Schools, other;
(f) Accessory buildings/structures.
(6) Government Services, Public Utilities and Quasi-Public Facilities. Auxiliary facilities that provide electricity, sanitary sewer services, water, transportation services, communications and other related services for public consumption. Quasi-public facilities under this heading shall include houses of worship and other meeting facilities for the public, but shall not include educational facilities (except Sunday schools and preschools).
(a) Transit station;
(b) Park-and-ride facility;
(c) Sewage lift stations/water wells and pump stations;
(d) Electrical substations;
(e) Electrical transmission lines;
(f) Preschools;
(g) Parking lots/garages;
(h) Accessory buildings/structures.
(7) Recreational Facilities and Open Space Uses. Active or passive recreational areas or facilities engaged in providing leisure-time services.
(a) Passive urban open space.
(b) Playgrounds/tot lots;
(c) Community parks. (Ord. 1249 § 3, 2009; Ord. 1164 § 4, 2004).
17.77.070 Development standards.
(1) Dimensional Standards.
(a) Minimum Acreage: None.
(b) Building Heights. Maximum heights shall be as follows:
(i) Forty feet for transit station.
(ii) Thirty feet for all other buildings.
(c) Density. Maximum density for residential units is 24 dwellings per acre.
(d) Setbacks. All buildings shall be set back from street frontages, pedestrian corridors, and the parking lot at least 13 feet to accommodate an eight-foot sidewalk or pedestrian corridor and five feet of landscaping. Side setbacks from adjoining buildings are not required.
(2) Design Standards.
(a) Pedestrian Orientation. All buildings shall be designed for pedestrian orientation, utilizing the architectural design standards in SMC 17.112.050.
(b) Buildings may provide entries and shall provide windows along any pedestrian corridor.
(3) Parking Standards. Parcels in the transit overlay are regulated by the off-street parking requirements in the MB-I zoning district in SMC 17.105.110. Other design standards of Chapter 17.105 SMC shall still apply.
(4) Landscaping. The applicant shall submit a landscaping plan for the entire site that meets or exceeds the standards of Chapter 17.145 SMC.
(5) Other Sections of Codes and Standards. The specific standards in this section shall override the corresponding standards of the underlying zone. Nothing in this section shall override other sections of the Stanwood Municipal Code or the public works standards, except as noted herein. (Ord. 1249 § 4, 2009; Ord. 1164 § 4, 2004).
