INSURANCE REQUIREMENTS FOR TEMPORARY USE PERMITS

3.30.005 Insurance requirements.

The following shall be required for all temporary use permits unless modified by the common council. (Ord. 2248-11 § 1 (part), 2011)

3.30.010 General liability coverage.

A.    Commercial General Liability.

1.    One million dollars ($1,000,000.00) general aggregate.

2.    One million dollars ($1,000,000.00) products – completed operations aggregate.

3.    One million dollars ($1,000,000.00) personal injury and advertising injury.

4.    One million dollars ($1,000,000.00) each occurrence limit.

B.    Claims made form of coverage is not acceptable.

C.    Insurance must include:

1.    Premises and operations liability.

2.    Blanket contractual liability.

3.    Personal injury.

4.    Products/completed operations.

5.    The general aggregate must apply separately to this event. (Ord. 2248-11 § 1 (part), 2011)

3.30.020 Business automobile coverage.

A.    Limits: one million dollars ($1,000,000.00) combined single limit for bodily injury and property damage each accident.

B.    Must cover liability for “any auto” including owned, non-owned and hired automobile liability. (Ord. 2248-11 § 1 (part), 2011)

3.30.030 Workers’ compensation and employers’ liability – If required by Wisconsin state statute or any workers’ compensation statutes of a different state.

A.    Must carry coverage for statutory workers’ compensation and employers’ liability limit of:

1.    One hundred thousand dollars ($100,000.00) each accident.

2.    Five hundred thousand dollars ($500,000.00) disease policy limit.

3.    One hundred thousand dollars ($100,000.00) disease – Each employee. (Ord. 2248-11 § 1 (part), 2011)

3.30.040 Aircraft liability (including helicopter) – Owned, non-owned or hired.

A.    If this exposure shall exist, the limits must be at least five million dollars ($5,000,000.00) combined single limit for bodily injury (injury passenger liability) and property damage.

B.    Any liability exclusions relating to slung cargo must be deleted. (Ord. 2248-11 § 1 (part), 2011)

3.30.050 Umbrella coverage.

A.    Limits: two million dollars ($2,000,000.00) each occurrence/two million dollars ($2,000,000.00) aggregate.

B.    Claims made coverage is not acceptable.

C.    Maximum of ten thousand dollars ($10,000.00) self-insured retention.

D.    Must be no less broad than underlying coverage. (Ord. 2248-11 § 1 (part), 2011)

3.30.060 Liquor liability.

If the event holder is selling alcoholic beverages, then liquor liability with the following limits and coverage must be carried:

A.    Limits: one million dollars ($1,000,000.00) each occurrence/one million dollars ($1,000,000.00) aggregate. (Ord. 2248-11 § 1 (part), 2011)

3.30.070 Additional provisions.

A.    Additional Insured – On the General Liability Coverage, Business Automobile Coverage and Umbrella Coverage. City of Brookfield, and its officers, council members, agents, employees, and authorized volunteers shall be listed as an additional insured.

B.    Endorsement. The additional insured policy endorsement must accompany the certificate of insurance.

C.    Certificates of Insurance. A copy of the certificate of insurance must be on file with the city clerk at least five days before the start of the event.

D.    City of Brookfield requires thirty (30) day written notice of cancellation, non-renewal or material change in insurance coverage.

E.    The insurance coverage required must be provided by an insurance carrier with the “Best” rating of “A-VII” or better. All carriers shall be admitted carriers in the state of Wisconsin. (Ord. 2248-11 § 1 (part), 2011)
