9.32.010 Loitering of minors.

No minor under the age of seventeen (17) years shall loiter, idle, wander, stroll, play or congregate in or upon the public streets, highways, roads, alleys, parks, playgrounds, public places, public buildings, places of amusement and entertainment, vacant lots or other unsupervised places, whether on foot or in or upon any conveyance being driven or parked thereon between eleven p.m. and five a.m. of the following day unless accompanied by his parent, guardian or other adult person having the care, custody or control of such minor. The prohibition of this section shall not apply to any person under seventeen (17) years of age who is going to, attending or returning from any legitimate business or activity which has been specifically approved in advance by his parents, guardian or other adult person having legal care or custody. This section shall not apply where the actor was exercising first amendment rights protected by the United States constitution or the Wisconsin constitution, including freedom of speech, the free exercise of religion, and the right of assembly. Unless flight by the actor or other circumstances makes it impracticable, a peace officer shall, prior to issuing a citation for an offense under this section, afford the actor an opportunity to explain his or her reasons for being present in the public place. A peace officer shall not issue a citation for an offense under this section unless the officer reasonably believes that an offense has occurred, and that none of the exceptions described in this section apply. 9.32.020 Responsibility of parents.

No parent, spouse or guardian or other adult person having legal care or custody of a person under the age of seventeen (17) years shall suffer or permit or, by insufficient control, allow such person to violate the provisions of Section 9.32.010; provided, any such parent, spouse, guardian or other adult person who shall have made a missing person notification to the law enforcement authorities shall not be considered to have suffered, permitted or allowed any person to be in violation of Section 9.32.010. 9.32.030 Responsibility of hotels and motels.

No person operating a hotel or motel, or their agents or employees, shall permit any person under the age of seventeen (17) years to visit, loiter, idle, wander or stroll in any portion of such hotel or motel between eleven p.m. and five a.m. of the following day; provided, this section shall not apply when the minor is accompanied by his parent, guardian or other adult person having the care, custody or control of such minor. 9.32.040 Loitering in school and playground area.

No person not in official attendance or on official business shall enter in, congregate, loiter, wander, stroll, stand or play in any school building in the city, or in or about any playground area adjacent thereto between seven a.m. and four p.m. on official school days; provided, this section shall not apply to one who is a guest or invitee of the school authorities. 9.32.050 Penalty for violation of this chapter.

Any person, firm, partnership, or corporation who violates any part of this chapter shall be subject to the penalty and enforcement provisions in Chapter 1.12. (Ord. 2552-19 § 10, 2019)
