12.20.010 Permit required.

No person shall fill land in the city without first obtaining a landfill permit from the city engineer. (Prior code § 8.07(1))

12.20.020 Conditions of license.

Issuance of such permit shall be predicated upon a finding by the city engineer that no natural drainage courses will be obstructed; that the filled land will reasonably conform to nearby road grades; that flooding and erosion reasonably will be avoided; that no dust nuisance will be created; that there will be no substantial adverse effect on the public health, welfare and safety. The city engineer may prescribe conditions for such permit necessary to accomplish such purposes, including the fixing of grades, a time limit for the proposed landfill operation, and a cover of grass or other suitable vegetation. 12.20.030 Grading and seeding.

Grading shall be completed within ten days after the landfill has been concluded. Seeding shall be completed within thirty (30) days after the conclusion of grading, subject to reasonable extension by the city engineer in the winter months. (Prior code § 8.07(3))

12.20.040 Penalty for violation of this chapter.

Any person, firm, partnership, or corporation who violates any part of this chapter shall be subject to the penalty and enforcement provisions in Chapter 1.12. (Ord. 2552-19 § 34, 2019)
