12.35.010 New subdivisions.

1.    Subject to the provisions of ETMC Title 17, a subdivider, as referenced in Wis. Stat. Ch. 236, shall provide sidewalks, curbs, gutters, storm sewers, and streets. In addition to the foregoing; provided, that sanitary sewer and water is available, the subdivider shall provide extensions thereof to and throughout the subdivision.

2.    All streets will be constructed in conformance and accordance with Wis. Stat. § 82.50, and shall be surfaced with a minimum two-inch mat of rolled hot mix asphalt to a surface width of at least 20 feet. No streets constructed by a developer or subdivider as a public street will be accepted or considered accepted or dedicated until the provisions of this chapter have been complied with.

3.    The work, installations and construction required in subsections (1) and (2) of this section shall be arranged by the Town by letting of a contract on bids to the lowest responsible bidder.

4.    The cost of the foregoing shall be the property owner’s. The Town Engineer or an engineer designated by the Town Board shall make an estimate of the cost of said improvements and at the time of submission of the final plat of subdivision or certified survey as the case may be, the subdivider shall pay the estimated amount in cash which shall be credited against the final cost when determined, at which time the subdivider shall be billed for the balance. As an alternative to the deposit of cash, the subdivider may in lieu thereof submit with the final plat of subdivision, a performance bond in the penal sum of twice the Engineer’s estimate.
